Xotick is hereby Riven that the Com mon Council propose, to order tho im provement ot that portion of West Sixth street in the city of Astoria as laid out and recorded by J. M. Shively in Clatsop county, Oregon, from the south side of Waier street to the south side of Cedar street, by removing all de fective piles, caps and stringers and re placing them with new and .-.ound piles, caps and stringers, and by raising it to the established grade, and by planking the sani8 with new and sound fir plank four inches in thickness to the full width of the street, and by building sidewalks on both sides cf said portion of said street. That no person or persons shall in the City bf Astoria,Clatsop coun ty, Oregon, either directly or indirectly, in person or by another sell, barter or deliver, or knowingly permit to be sold, bartered or delivered, tor or on his or their account, any wine, malt or spiritu ous liquors to be drank on the premises owne.1 or occupied by him or them, without first obtaining a license so to do. in the manner in this ordinance hereinafter urovided. See. 2. Every person applying for a license to sell wine, malt or spirituous liquors unaer mis orainance in uny auantitv not less than one nuarf. shall pay into the city treasury the sum of one hundred dollars for one. year, and every person applying for aJicense to sell wine, malt or spiritous liquors un der the provisions of this ordinance In quantities less than one quart, shall pay into the city treasury the sum of two bund red dol lars for one year. Provided, that no license shall be issued under this ordinanco for a less period than one year, and that such license shall not be transferable, Sec. 3. Before a license, shall issue as provided for in this ordinance the ap plicant snau petition me uommon Council in the manner provided for in Section 4 of tills ordinance, and shall also witli said petition nresent to the Common Council a bond in the sum of five hundred dollars with two or more sureties, payable to the city of Astoria, conditioned that he or they will keep an orderly house and will in all things comply with the provisions of this or dinance during the period of one year from the beginning of such license. Attached to said bond shall De an affi davit verified by the oath of the sureties to the effect that they are free-holders in the city of Astoria and are In the ag greeate worth the sum of one thousand dollars over and above all just debts and liabilities and property exempt from exer-ution. The applicant shall present with such bond and petition a receipt of the treasurer for the amount of money deposited for such license. Sec. 4. The petition required by this ordinance shall state: 1st. The name of the applicant. 2d. Whether such applicant lias be fore held or holds at the time of appli cation a license, and If so, at what date such license has or does expire. 3d. At what dates such applicant de sires such license to begin aud expire, aud the place where such liquors are to be sold. Such petition shall be verified by the applicant or if more than one by at least one of such applicants, stating that such petition is true. Sec. 5. The receipt of the treasurer mentioned in section 3 of this ordinance shall state that the amount paid by such applicant is paid for a liquor li cense to be refunded in case the Com mon Council shall refuse to grant the petition of the applicant, otherwise upon the issuing of such license to go into the funds of the city. Scc.fi. Upon the granting of such petition by the Common Council the Mayor shall examine the bond of the applicant and either approve or disap prove tho same. Sec. 7. Upon the provisions of this ordinanco being fully complied with the Auditor and Police Judge shall is sue such license to such applicant. Sec. a. Tho bond to be given by the applicant, as provided in this ordinance, in case of a violation of any cf its pro visions and conditions shall be liable to be prosecuted therefor in a civil action, and it shall be the duty of the Auditor and Police Judge of the city of Astoria to prosecute the bond given by such ap plicant, for any violations of its condi tions. Sec. 9. Any keeper of a bar-room or drinking shop who shall permit any breach of the peace or disturbance of the public order or decorum, by noisy or disorderly conduct on the premises, when it is in his or her power to pre vent the same or who shall sell or give any intoxicating liquor to any person already intoxicated, or to any person under the age of legal majority, or who shall allow or permit any minor to re main in or about any bar-room or drink ing shop under his or her control, shall be deemed guilty of a misdemeanor, and upon conviction thereof before the Po lice court, bo fined not less than twenty-live nor moro than one hundred dol lars, or by imprisonment In the city jail, not less than twelve nor more than twenty days, and shall forfeit the li cense to such bar-room or drinking shop. Sec. 10. Any keeper of a bar-room or drinking shop who shall permit or era- Eloy any woman to act as waitress or ar-tender, or to sing or dance, or to serve m any other capacity in such bar room or drinking shop or who shall em ploy any person to sing or dance in such bar room or drinking shop, or who shall permit any theatrical or minstrel show, exhibition or concert to take place in such bar-room or drinking shop, or who shall allow or pormit any minor to be or remain In any theater or place of amusement in which intoxicating liquors are sold, shall be deemed guilty ot a misdemeanor, and upon conviction thereof boforo the Police court, shall be fined not less than ten nor more than one hundred dollars, or by imprison ment in the city jail not less than five nor more than twenty day3, or both, in tho discretion of tlw cour', and shall forfeit tho license to such bar-room or drinking shop. sec. 11. Each and every place where any wines, malt or spirituous liquors are so,d, bartered or delivered to be drank on tho premises, shall be deemed to be a bar-room or drinking shop un der tho provisions of this ordinance. Sec. 12. Each and every person hav ing a license under the provisions of this ordinance shall exhibit the same at all times, while the same Is in force, in his or their place of business. Any per son violating the provisions of this sec tion ,shall upon conviction thereof be loro the Police court be fined not to ex ceed fifty dollars or by imprisonment till such fine is paid not to exceed twen ty days. Sec. 13. That ordinanco No. 870, en titled "An ordinance amending section 2 of ordinance No. 587" approved De cember 23d, 18S5, and ordinance No. 872, entitled "An ordinance providing for the execution of a bond by any one wishing to obtain a license to sell spir ituous liquors," approved January 20th, 18SG, and ordinance No. 952, entitled 'An ordinance amending ordinance No. 587, entitled an ordinanco to pro vide for licensing and regulating bar rooms and drinking shops within the corporate limits of the city of Astoria, Clatsop county.
