The decision of Judge Kelson, of the Federal court in Boston, as telegraphed, is in one sense a det riment to the coast. It is in effect that Chinese coming from Hong Kong are not Chinese: that all our efforts to keep out those fel lows aie unavailing', and all that a Chinaman who wants to evade the law has to do i.s to pass through Hong Kong. It is just like what a Massachusetts judge would do, but it can not be assailed. Judge Nelson, in making that 'decision has simply passed upon the letter of the law, and ignored its spirit. His decision finds justification in a strict construction of the law. On the Gth of May, 1S82, con gress passed an act over the presi dent's veto; this act prohibited Chinamen from coming here for ten years. That act was passed in pursuance of a treaty concluded with China rescinding so much of a previous treaty as allowed un limited immigration of these peo ple. Congress set up that rule because the Chinaman is u forager instead of settler; because, as the Jjiillclin says, he is wholly and absolutely unassimilable; because he has been introducing new and ruinous vices among our people; because small-pox and leprosy, in separable from his low state of civilization, follow him wherever he goes; because he drains the country of its wealth in stead of adding to it; be cause he degrades labor by set ting up the Asiatic standard; be cause generally he is held to ser vice and is not a freeman; and be cause he is a polygamist without suspicion of moral wrong. Two Judges of the Circuit Court of the United States in Massachusetts have been found who maintain that the Chinamen sheds all these undesirable characteristic, prac tices and tendencies by passing through the little English colony of Hongkong, situate at the mouth of the estuary which leads to Canton, and, in some places, not more than a half mile distant from the main land. This little island is English, in the official sense, but nothing more. The greater part of its commerce is in the hands of Chinese merchants, who have founded houses there to escape what is known as the Mandarin 'squeeze" at home. The pop ulation in IS! 1 was 1 24,194, most ly Chinese. The Massachusetts Judges hold that streaming through that little gate-way, so to speak which, by the way, he must in an- event seek for shipping to this country the Chinaman becomes another individual altogether, looses his vices, is stripped of his hereditary tendency to contagious diseases, and is altogether:! lovely and de sirable addition to our population. Instances of what is known as Judge-made law are quite com mon in this country. That is the kind of law we get when a Judge thus legislates. Congress had' no idea of making any such law the Massachusetts Judges have discovered. It had loo much hard common sense to set up an excep tion that would be certain to de stroy the rule. If the Chinaman from Hongkong is to be admitted, how is the Cantonese to be sepa rated from him? The judicial leg islation to which reference has been made, is displayed more frequent ly in the judiciary which, holding office for life, lives in the atmos phere of the clubs, imbibes the notions of the pseudo-aristocrats, and in time becomes wholly sepa rated from the people, their wants and necessities. Unfortunately there is a decision of the circuit court of this state which furnishes a foundation in part for the Massa chusetts nullification, now under consideration. Perhaps no act was ever passed which has produced more unedifying spectacles, legal and official, than the Exclusion act. The secretary of the treas ury in connection with it allowed himself to be reversed by a sub ordinate. The attorney general of the United States has turned a summersault on it, for which a parallel can scarcely be found. Petty officials everywhere have1 been trying to drill holes in it. The motor is not difficult to find. It is the power .in behalf of which ;in the flush of recent victory, it has been proclaimed that it knows no intestine squabble in the face of the eneim. But it is narrow and contracted for all that, and ordi narilj has no range of view out side of an immediate dividend. Its short-sightedness has more than once brought overwhelming ruin upon it. The Rule of Three. A 2vuw Yoinc journalist inter viewed a prominent broker last Saturday, who said: "It has been known in Wall street for three days that Gould and Vanderbilt have been in close consultation over something or other, but yes terday it transpired that Villard was taken into the confidence of the two, and that hereafter they are to form a grand triumvirate." "What would be Gould's actual interests in such a combination?" was asked. "His southwestern system take? in the Texas and Pacifi', Kansas and Texas, Missouri Pacific and the Wabash Pacific. The Wabash furnishes his nearest point for an eastern outlet, the terminus being at Toledo, right on the lake shore. He wanted the Nickel Plate road, but the Vanderbilts stole a march on him, and bought it. Tits trans fer is to bridge over the gap U tween Toledo and Buffalo and this he can onty overcome by a coalition with Yanderbilt, and get it by way of the Nickle Plate. Yanderbilt can serve Villard by way of the Northwestern, which goes right to St. Paul. Villard only claims for his system that it affords a grand connecting link between the great inland lakes and the Pacific ocean. He can onbf Set to ew York over the Northwestern and that Yanderbilt controls." John" Mackay recently wrote to an old Nevada friend that he was coming out there to see how his old neighbors stood the hard winter. His letter leads the Car son Appeal to observe: ""We've had a pretty hard rub, but are still here, Mr. Mackay. "Wcsage brushcrs have spent most of the inclement winter months paving assessments on the north end mines. The snowstorms and as sessments are sandwiched in to gether rather thick, and it was a pretty hard rustle. "We felt a sort of state pride in seeing that. 3011 were well fixed for the coronation, and we felt our oats when we landed you in Moscow in such ex cellent style. The .winter left a lew of us solvent, and in the spring, gentle Johnny, we got our second wind and hope to sec you among us soon again.'' It will do no harm for Astoria to be somewhat chary of granting franchises and rights which in the future will be valuable out of all proportion to what they cost. This city is to have a splendid future. It is the history of many cities of promise that when in the same state that Astoria is at present the municipality surrendered to pri vate corporations many valuable rights that were afterwards sought to be recovered. "Without in the least discouraging corporate en terprise it will be well to profit b' example, and not be too prodigal in .granting that which in ten years from now wc will all unite in saying should have been re tained bj' the city for the benefit of the citizens and the common good. Vaxuerbilt's residence, Jay Gould's yacht and other billionaire appendages are to ie eclipsed by J. C. Flood, who will build in San Francisco a second edition of Aladdin's palace. It will out shine any private residence in America, will cost $5,000,000 to build; $25000300(L-4o furnish, and will be a prolific source of com ment for the newspapers. What a contrast Flood's $7,009,000 dom icile will be to the back room of the saloon where he used to shake the bones with his customers for the drinks in the days of auld lang svne.
