Tha'o all swine found running or being at large in the counties of Clatsop, Tillamook, Was co, Curry, Linn cQunty south of the Santiam, and Umatilla, and doing any damago to the land or other property of any person in said conn ties, may be taken up and safely kept, at tl 13 expense of the owner or owners thereof, !by any person so damaged. Sec. Alt person; taking up swine so trespassing up their land, or other 1 i -i i . i property, wiictuc-r mcioscu or not, shall immediately thereafter post up notices in three of tho most public places in tho neighborhood, in which such trespass shall have been com mitted, containing a description of the ear and other marks of such swine, whereby tl;e owner may iden tify thorn as his property Sec. That if the owner of such swine shill come forward in ten days after such notice are posted, and Ctor vo such swine to bo his property tho person, so taking shall deliver tlie same to such owner, upon his paying all costs, charges and damages, sus tained by reason of such trespass and taking up. Sec. -1. If, however, tho owner docs not come forward within ten days jxf ter such notices were posted as 'provided, in the-preceding section, then tho person taking up such swine shall immediately notify a Constable of the county, and said Constable shall proceed to sell, at public auction, after giving five days notico of such sale, by posting no tices in three public placed in said county, all such swine so taken up; Provided, however, that the owner may prove his property and receive tho same by paying all costs, charges and damages, at any time before such sale takes place. Sec. o. If the parties cannot agree as to tho amount of charges and dam "ages, then each person shall choose one disinterested person, and they may choose a third person, who shall determine tho amount thereof. Should the owner hot come forward, then the Constable shall appoint j three disinterested: persons to deter mine the amount. Sec. OoTho foes of the Constable for making sales, finder tho provis ions of thii-act shall be tho same as arc allows by the taws for sales under execution. Sex 7. If tlieio should be any surplus money arising from such sales, after'paying all costs, charges, and damages, tho Constable shall pay tho samo to tho owner of such swine sold; Provided, said owner make proof within fifteen days after such sale, that he is entitled to the same. If no proof shall be made with fifteen day a, the Constable shall pav tho same to the county- Treasurer, taking his receipt for the same. Sec. 8. All monies paid into the county Treasurer, under the provis iins of this act, shall become a part of the common school fund of said counties 'bf Clatsop, Tillamook, Wasco, Curry, Linn and Umatilla. Sej. V. Any Constable refusing or neglecting to pay the county Treasurer, as tho .lase may bo, the surplus derived from any such sale, shall be liable for tho same on his official bond, r.ad shall be deemed guilty of embezzlement, and on con viction thereof, shall be punished according to the existing laws in nuch cases made and provided in this State. An Act to amend an act, entitled " An act to create, organize and locate tho University of tho State of Oregon. lie it enrtck'i by the Lejishitive Assem bly of tlic. itafe of Oreyon : That section 11 of said act bo amended o as to read as follows: The Union University Association rf Eugene City, Oregon, shall on or leforo tho first day of January, lSi 1 secure a site for said University, at or in tho vicinity of Eugene City, ftny erect thereon and furnish a building for tho use of the State University in a place to be approved and after "the erection of the same to be accepted by tho Board of Com missioner for tho sale and manage ment of the school and University lands, and for tho investment of the funds arising therefrom, said build ing, furniture and site to be of not n I less value than fifty thousand dol lars. That section 12 of said act be amended so as to read as follows: Be it further enacted that in case the said Union University Associa tion shall fail to comply with tho provisions of section 11 of this act and to make good and sufiicient con veyance of said site and building in fee simple, free from all encum brances, to the Hoard of Directors of thoUniversitv of the State of Oregon on or before the lirst day of January 1877, then in that case this act shall become void and of no effect what ever.
