The enormity of offenses against human beings and society, is often measured by a false standard that has been established through mis conceptions, or sentimentality on the part of the majority of people. Certain it is, however, if there is any crime that deserves a condign punishment, that crime is the act of train wrecking, that put the lives and persons of so many peo ple in jeopardy. California lias led the way in making the death penalty a punishment for it, and an eastern paper says that the "extent of railways in this country, running through areas not thor oughly settled, furnishes a condi in which the train wrecker can not well be prevented, by any system of watching which the companies The will business seems to have been more thoroughly mixed up than usual, by a wealthy Can:lian, lately deceased. In either case there ia grave cause for public concern. The barbar ism and horrible consequences ol the crime have elicited attempts at discussing remedial measures. Naturally everybody feels that thorough prevention is an impossi ble task ia the present circum stances. The easiest groove into which writers may enter is that running toward more severe pun ishments. If these would stop the crime there should be no hesita tion as to the decision. The his tory f jurisprudence does not point to any general success by that method. However, it is certain that human nature demands sat it-: faction for wanton outrage, and is also certain that as regards render-! ing villains harmless there is no penalty so irreversible as the death penalty. The California law deals with train wreckers in the manner indicated, providing that any per son who t'lacea dynamite or any obstruction on any railroad in the state, or attempts in any way to wreck a train, shall be guilty of fkny, punishable with death. As the I'rovidence Journal remarks: 'It ia a strange system o! justice which hangs a man for killing an other and inflicts only a few years of imprisonment on one who tries! lo wrecK a train witii scores or hundreds of people on board Hence it favors the adoption of the California law in other states. What objection can there be? The death penalty is essentially pre ventive as far as the convicted criminal is concerned, and not cruel in a distinctive sense. Still the social security must ever rest more upon the humanity of the masses than upon the degree of punishmen. There are many other crimes which can not be en tirely prevented, yet of course they are rare as compared with the opportunities which present themselves for committing crim. Were it not so human society would be an utter failure. The ground on which the severest pen alty must be urged is that the crime is one of the worst. It be' speaka total depravity as nearly as any! ct that a bad man can set hia wicked brain to plan and his devilish hand to execute any sulphur.
