Patrons of the paper will please observe the change. THE TEST OATH. In the matter of abrogating the influence of the Mormon church heirarchy, perhaps the most ac tive and potent factor so far has been the decision of the United States supreme court, in uphold ing the constitutionality of the test oath adopted by the Idaho territorial legislature, The decision will cause intense satisfaction in that territory where it. originated, and which has been foremost in the active efforts to oppose the polygamous Mormons. The oath reads as follows : That I am not a member of any order, sect, or organization which teaches, advises, or encourages the practice of bigamy, or poly gamy, or any other crimes defined by law as a duty or privilege re sulting or arising from the faith or practice of such order, sect, or organization; or that teaches, counsels, encourages, or advises any person or persons to commit the crime of bigamy or polygamy, or any other crime defined by law, as a religious duty. That I am not a bigamist or polamygist. That I do not not either publicly or pri vately teach, counsel, encourage, or advise any person or persons to enter into polygamous relations, or into the relation known as "plural or celestial marriage." That I regard the constitution of the United States and the laws thereof, and of this territory, as interpreted by the courts, as the supreme law of the land ; and that I will support and uphold the same, the teachings of any order, sect, or organization to the con trary notwithstanding, so help me God. It will be seen that this test oath, which the United States supreme court has rendered effec tive by its decision, completely shuts out every Mormon who in dulges in a plurality of wives, and most effectually squelches the peculiar institution. It will ex tend its sway beyond the confines of Idaho, where it orginated, and capture the situation in the ad joining territories. Utah will euccomb to the test oath, and . it will follow up wherever the Mor mon influence has spread until the polygamous element is fully exor cised. The taxation question on the ingle, or land tax theory, con tinues to be a question that is much talked and considered. It brings up the land ownership as the main fundamental question. As has been said, by natural law land is owned by all men in com mon. The first taker or occupant might rightfully appropriate so much to his exclusive use as a proper use thereof permitted. His possession, to the exclusion of every one else, might continue so long as he used the land, or while he was using it. Upon possession ceasing, his right to use it ceased, and the land was again held in common, subject to be again ap propriated for use. Insecurity in . the use, Bince the occupant's labor added to the soil what before it was devoid of a common com mercial value necessitated a more substantial tenure, a sort of prop erty in the soil which is called private ownership. To secure this to individuals, social governments and social laws sprang into being. These latter, either by common usage long established and ac quiesced in, or by express provis ion, not only recognize but assert the law of nature in respect to property in land. Sale of land in occupation of an individual is an act indicating his intention to abandon it, a grant or conveyance being the means established by social law to signify this intention. The purchaser, being the first ac quainted with such purpose, seizes the vacant land, and is the next taker by natural law. The consid eration paid represents toa capital and labor expended in the Jand by all occupants, and the justice of such payment is sustained, .by every principle of -naturaWaw and moral right, since the capital and labor ao expended represent all the oommercial value that the land possesses. And, finally, to deprive the individual of his oc cupancy and possession, although it be to reinstate the owners in common, can only be in natural justice and moral right upon pay ment of the value of the capital and labor represented in the land, which is the whole oommercial value of the land. - It follows, then, that the demands of natural justice and moral right would be ignored if all taxes were put upon land, because one form oaly of labor and capital would be thus compelled to bear the whole bur den of taxation. The trouble in the discussion of this matter is that theories only are promul gated and the practical side of the question ignored. The transforming of the aergy lodged in water power over long distance, by the aid of electrical machinery has become one of the leading enterprises of the country, i and will eventually make available very many of the isolated water . powers that possesses great power that heretofore could not be used ' on account of isolation. The new French ministry are evincing ability, and creating a faith and confidence in the govern ment not appreciated before. NEW TO-DAY.
