He says he lias bought and will soon open one of the finest lines of crockery, chinaware, silver and porcelain ware ever seen in Albany, which will positively be sold cheaper than anv house on the Pacific coast. A Queer Predicament. The suit brought by District At torney Belt against Linn county for $135 attorney fees due his deputy, L. H. Montanve, for serrices in criminal cases was decided Mon day in favor of the district at torney and Mr. Montanye obtained a transcript of the judgment and demanded the money of Tre lsurer Farwell. It was ot course paid, and last night after getting the money in his pocket Mr. Montanye was served with a notice of appeal by the attorney in the case. J. J. Whitney. Since judgment has been rendered and the money paid the appeal seems to be a trifle late. lAs a matter ot tact the claims ought to have been paid by the county at first w ithout :he expense cf a suit. CITV 'UXCIL. Aljoarneed Meeting and Usual Eoitine of Business Transacted! The adjourned meeting of the city council convened last evening. ; Councilmen nil present excepting councilman Kaed. In the absence ol tiie mayor Councilman Grad wohl was elected to till the place fjr the evening. The uommiuee on accounts and current exp miscs reported sundry tili and asked for iurtnur time o:i officers' reports. The committee on health and police reported on the petition of A. Cinmnigaam .11 relation to manure thro vmi out on adjoining property to him, finding it a nuisance and o "deiing it aoated, which report was adopted. The committee on ordinances re- pj ted, recommending the adoption kjl an ordinance granting an exclu sive right for gas works in the citv to the ban Francisco parties for l'o years, and also a like ordinance granting a like franchise to Mr. Allen for his eiectric iglit works. Committee on streets and public property reported recommending a new sidewalk on the east side of Lyon street between 2d and 3d streets, which report was adopted, a id the walk ordered built. Special committee on the Dr. E. A. McAllister damage case report ed that they lutu engaged J. K. Weatherford and D. It. N. Black burn to defend the case. The ac tion of the committee was ratified. c-anic committee on petition ot G. V. Smith for privilege of put ting up a telephone asked further time. Marshal Hays reported in refer ence to property owners connecting with sewers. The committee on streets and public property was in structed to act in conjunction with the street commissioner and act upon tiie matter. The matter of railroad street sewer was brought up and the work accepted and ordered paid, and also the sewer at and across the street at the engine house. The street commissioner re ported in reference to culvert on 7th and Jefferson streets, which was referred to the committee on streets and public property with power to act. Tiie street commissioner was in structed by motion to see that the side .valks. shall be repaired imme diately. The recorder reported that the insurance on No. 2's house had been procured reissued one year. The action was ratified. Application of the Chinaman who had started a wash house on 1st street for more time in which to move was not acted upon. Petition of J. Fox in regard io nuisance in block S was referred to the committee on streets and pub lic property. The petition of N. A. Blodgett in regard to changing the fiume sup plying his miil from Broadalbm stieet to Ferry street and thence by Water street to his mill was re ferred to the committee on streets and public property. On motion the Southern Pacific railroad was instructed to remove the rubbish on Kailroad street within ten days, Contract was let to C. A. Creel for a sewer on Baker and Lyon streets at the rate of 75 cents per foot, to be completed in ten days. A committee of three were ap po nt-d with the mayor to look -V-Tthe charter and recommend what amendments were necessary and report at the second meeting meeting in November. J.N. Hoff man, B. F. "Daddv Xolan ' bv ! the great Dan'l Sully comedy com pany at the opera house to-night, promises to be one of the best ever put on the stage in this city. The New York press says of it: "The first act is a happy blending of humor and pathos, with a particu larly strong ending. In the second act the audience is introduced to Daddy Nolan in poverty. The scene is very lively, and kept the people in front of the footlights in roars of laughter. In the last act, a scene on. Brooklyn Heights, the company introduced a number of clever specialties, Mr. Mat Arnold being especially "ood. The s; en- ery of the play is the best ever seen on that stage, and would be a credit to any theater. The last act showing a view of Brooklyn bridge, with the cars and ferryboats in full motion, is very realistic. Mr. Sully was the Daddy Nolan, of course, and proved himself to be an actor of great merit. His pathos was strong ami eflective and his humor infectious. Daddy Nolan is as good a play as Edward Harrigan ever turned out. It is a genuine success, and has brought -Mr. Sullv into the front rank as an author and comedian." Nearly the entire time of the court was occupied yesterday in hearing th,? suit of tiie Oregon Pa cific railroad against G. W. Hurt for damages, and it is still at issue. Geo. Maley and James Pitsford, who were indicted for selling liipior without licen-e, were ar raigned and gave until to-day to plead. Julius Graf was indicted for lar ceny in a dwelling. L. O. hultz was indicted for selling liquor on Sunday. James W. Cross, who was in dicted for larceny, plead . guilty, and was sentenced to the peniten tiary for one year. La- Francis, divorce ; granted luiiiiiiiruliou Matter. Already the tide of emigration has set in and every day finds quite a number of eastern people looking over our country with a view to locating. They are impelled by the approaching winter to seek homes in milder climes and as the advantages of the favored Wil lamette valley are becoming known to the world we are securing our share of the influx. This is ex actly what is required to develop this country. We need people. When it is once known what great advantages we have and what great inducements are held out to the home-seeker it is no wonder we should receive, our proiortion of the army of emigrants. Those who stay long enough to see what we have, are sure to remain per manently. Salem Journal Bridge Matter. The floor beams of the suspen sion bridge at Oregon City are laid, and people can now cross the river on it. It only remains to lay the floor and buiid the approaches to complete the work. A number of the workmen, says the Oregonian. have been brought down here to lay the new track for the turntable at the Morrison street bridge. The iron is all here, and if the weather is piopitious the work of laying the new track and putting in the new wheels will probably be begun to day. The completion of this job will enable the draw to be opened and closed in less time than is re quired at present. Take Care or Them. It is an established practice when domestic animals of anv kind commit depredations, the owner is required to pay for the damage. Under that practice Mr. P. H. Bowman wants the State of Oregon to hereafter restrain the Chinese pheasants from trespass ing upon his premises and pay for the damage they have committed and are committing, as the state of course owns the birds. Salem, Oct. 24. Robert Maher, a U. S. prisoner, confined in the penitentiary, was to-day released, superintendent Downing having received for him a presidential pardon. Maher was a piivate in Co. I, 2d U. S. Infantry, and was courtmartialed at Ceur d'Alene on March Bi, 1SS5. and was dishonor ably discharged and sentenced to seven years in prison for robbery, burglary and absence without have. The Oregon penitentiary was designated as his place of con finement. Pardon is full and un j conditional and the grounds upon "vhieh it is granted are stated to be the conflicting testimony against Maher at the trial. The same witnesses havi::g charged the same offenses against another prisoner on an )ther trial. THE ASTORIA RAILROAD. The Salem and Astoria railroad committee to-day recen ed a letter from the Astoria li. It. Co. and will consider it in a meeting to morrow. It is understood to be very favorable to the project. YOUNG DE HARD DISCHARGED. James DeBard, a Polk county boy, arrested on suspicion of being a burglar, w?s to-day discharged, there f being no evidence against him. TROUBLE IX CHINATOWN. George Sun Lee Ho and George Hong, Chinamen, the former of whom is well known, were arrested last night on charges of gambling, at the institution of one Sing Song. To-day they were discharged and the cost taxed to the prosecuting witness, it appearing that the ar rest hail been caused by spite work. .v;ku.sa ix.jisth i:. I most strenuorsly object to the report of a so-called "government commissioner of agriculture, "which appears in the telegraph columns of the Oregonian of Monday. He saA's that "in Oregon there is much complaint ot a reduction of the yield from early frp.hij,rnhi in Juiv, hot weather in Jul', ami llijht ami -" (the italics are mine), and I presume that if there were any changes he could ring on that "line of thought," the commissioner would have added them. He must have been perusing the June elec tion returns, thinking they were so-called "crop reports," or ele this democratic official is using this wav to get even on our great state for the enormous democratic majorities that failed to material ize in the June election. If ther.i has been failure of crops in Oregon this year, we of the W i lamette Valley have failed to hear of it up to date, or even of rust or blight anywdiere in the state. Who furnishes this sort of a re port to be published broadcast about our state, anyhow? Would it not be a good plan, in tiie bril liant language of the Texas states man, Roger (I. Albany TBAJ1PS IVlh. They Break Jail and Are Fired Upon by the Police. The usual exciting encounter with tramps occurred at the city jail shortly after midnight yester day morning. Three tramps had been confined in the rickr-tv shanty called the city jail. Policeman McClain on his lounds discovered a tramp in the rear of the building industriously trying to pull the boards off to liberate ibis pals con fined inside. He started to rrn and when the officer called to him to stop he ran ihe faster The po liceman then tired two shots at him, but in the darkness missed him. ' Yesterday morning it was dis covered that the three tramps had escaped from the jail. The hole in the building has been patched up, but it is in no way a safe place for prisoners.
