It was very little encouragement that Captain Van." carried to Harry the next morning, l'e.irt was wo) se a great deal worse, and one of the servants had found a little dagger in the ivy under the library window. It waa a little nniijiie aii'air. more of a plaything than a weapon ttiat was likely to be used for so foul a murder, but it had the letters li. li. engraved upon the handle and everyone soon discov ered that II. li. were the enitials for Harry l'.urton, and of course, it was hi, and of course he had thrown ii out of the window after suiobii g tne general with it. Fo, u Iar opinio 1 was so certain of Harry's guilt and the indignation so strong m consul ;ence that it is a wonder tiie soldiers did not form them sctves into a mob, attack the prison, demand :he prisoner and tear him limb from limb. "Now, Harry, don't you go and get down hearted," said the cap tain in a cheerful tone, which lie was far from feeling. "Tilings iook mighty bine; but we will pull through home way. I've given yur case over to JSir. Cariwright, lie wili be i.ere in an hour to talk to you. You can trust him. He is the smartest lawyer in the United States they say maybe in the whole world for all I know, and if him and ine "can't save your neck re will just sell out.that's all. Then I've gotihe whole detective force out hunting the murderer. He will be found no doubt before the trial comes "off,-; then you w ill be let out of here in' honor instead of disgrace. Don't you worry about Pearl, she hasn't done all the good the Lord intends she shall yet. She is not going to die, yon can depend upon that. I expect Bhe will be powerful sick that brain lever ain't anything to fool with ; but she has the best doctor, and the best nursing in the world, and she is young, and has a con stitution, and besides as I just remarked the Almighty ain't done with her on earth yet. She won't die till her times comes. So just keep up your spunk and I will just be teetotaly hang if I don't dance at your wedding yet old boy." But notwithstanding all the efforts put forth to save him, Harry was convicted of mnrder in the first degree. Through the influence of Mr. Cartwright, the attorney, the trial had been postponed two months, in hope that tne real culprit would be found, but all to no purpose. Jvo one could be found upon whom the least suspicion could be attached. On the contraiy it seemed the longer the delay, the more directly the finger of guilt pointed toward Harry. In the trial everything was made public, the coldness between the general and his daughter in regard to Harry. The general's request that she should marry Lieutenant Warren, her re fusal, and his disappointment in consequence, everything. Happily i'earl was spared the humiliation of listening to it. She was convalescing slowly, but was not w holly past danger of a relapse yet, and good old Doctor Allen would not hear to her being sum moned as a witness at the trial. Hairy arose to his feet to receive the sentence of death as calmly as if he stood beloiv the general re ceiving ojders to carry the stars ...rd r-nipes at lrii! in tlie oid parade grounds at Fort 1. All thmugh tiie iwi he had con ducted hu.:.-re!f in a manner calcu-i-.ed to win tiie sympathy of the ISAjQE!, -isa emiie crown ui curious and eager spectators why daily thronged the court room, in spite ot themselves. ho could look at unit calm, pale, strong, yet boyish face, ' and not leel u pang oi regret that they would soon luk ' upon it for the last time? Who could look into those clear innocent brown eyes and believe him guilty of such a deed. In answer to the question, "have you anything to sav why the sentence uf dear should not be passed upon you?" ile a'i.-v.ertfd "nothing, only I desire all these people to hear me .-ay that i am innocent." He swept the whole hou.-e with his frank, clear expressive eyes, and npeated in a clear loud vo'ce thai every one might hear "1 am inno cent," ami those few words carried conviction to very heart. There was not one of tln.se, who a week ago would have been ready to rend him in pieces, but was sorry now that the verdict had been guilty. The olci judge pronounced the sentence of death by hanging, in a trembling voice and a blanched face, as though he expected the wrath of (iod to descend and de mand a reckoning for sending tne innocent into eternity. J.Ir.Cartwright, Harry's attorney, sat with his face buried in iiis hands, arid more than one of the jurymen were sitting with the tears rolling down their faces while tiie' looked at liany, so cahn, so un conscious amazed, forgetting to wine ihem awav. And Captain Van. who hr.s tried to cheer Harry through ail this dreary time, how docs he lake it? He is just as cahn as ever, to ail outward appeaiance; but note those keen gray eyes how they, flash fire, that foot be-:ting a silent tattoo on the floor, those hands that refuse to be still; all this means, if a person could read his thoughts that he has not given ap yet all hopes of saving Harry ; that it is to be war to the death, and that he. will fight against a cruel, ignominious, premature final of that noble young life to the bitter end. ' Harry was remanded to the gloomy prison, in which so many long dreary hours had been passed, to await his execution. It was with a feeling of thankfulness that his imprisonment would! not be for long, that lie " once more crossed the threshold of that dark, damp cell. But, O ! what a bitter ending of all those fond hopes, those high aspirationst "It is hard so hard," he groaned aloud, as he sat down on a ragged corner of the straw matress, which served as bed, chair, and table, in short comprised the entire furniture of that lonely, cheerless place. He covered 'his face with bis hands, and sobbed, and groaned while reat tears the first he had blied since his infancy droppeu slowly from between his fingers. It was heard to know that his regiment had marched away with out him, hard to think some one else was in lront with the banner he had carried with so much pride. "O!" he thonght,- "how gladly would I have given this life in honor, in defense of that flag, but to die like this, a felon's death, for tlie w orst crime on earth. For the murder of Fearl's father my Pearl for whom l'would die a thousand deaths, rather than cause her o ne hour's pain." Did she think him guilty? Ah, tnat was hardest of all. If he could only see her just once. If she would only send him one comforting word, one sentence that she did not doubt his inno c nee, he could die happy he tiiought. But in all these long weary hours he had waited in vain for some message from her. Cap tain Van. bad assured him that he had delivered ail of Harry's mes sages in person, but to all his inquiries had invariably received the same answer, no reply. And now be must die without one ray of sympathy from her. Xo one to shed one tear o're his untimely end save one, good, kind, rough Captain Van Fleet would be sorry. Harry spent the remainder of tlie day aittr the trial alone, with his ouii sad ti ough's for company. As the iioiu oi twiliglii appruueb.- I ed,he was aroused by a light step in the corridor. He listened in tently, as he had listened to every cctsten in that corridor tor weeks past, thinking, hoping it might be bPeari coming to see him. Yes it approaches nearer.
