Col- Hogg Brings Suit to Obtain Possession 1 oi the Monteita Property. Col. T. E. Hogg, president of the Chegon Pacific railroad, began yes terday through hi? attorneys a tsuit ojf ejectment against Thc-s. Mon teith, sr., to obtain possession of the Montieth mills at the foot of Ferry street. This is a portion of the property included in the sale made to Col. Hogg about a year ago for .r30,000. Mr. Monteith de clares the saie to be illegal and re fuses to give up possession of the property. The suit was begun in Justice Dorris' court, the attorneys for the plaintiff being Wolverton it Irvine and W. R. Bilyeu, and I. K. N. Blackburn for the de fendant. Last Tuesday was pardon day at the executive department and Gov ernor Pennoyer and the advisory board ot" pardons considered a larye number of petitions that had been tiled, asking for the release of vari ous prisoners in the state peniten tiary. The cases of five men were considered worthy of executive cleuieney and their sentences were commuted to expire on Thursday, January 26th, but their names could not be ascertained, the gov ernor evidently thinking that the public has no right to pry into his public acts. Thursday the five pardoned convicts were released f'lom the pen and from officials of the penitentiary the reporter learn ed their names, crimes for which they were iucarcerati d, term of sentence and time served, which we give bel w : Thomas Riggs, of Linn county, was sentenced to a term o three yenrs, from November, K8(i. for obtaining money under false pre tenses. Strong petitions selting for'h his previous good character ami expressing a strocg doubt of guilt, caused the governor to par don him . T. H. Harris, sent up from Mult nomah county for four years from November 1884, for larceny in a dwelling,hnd qis sentence commut ed, upon the recominen lation of the prosecuting officer and a strong petition to the effect that he had been sufi'cieiitly punished. Win. Brown, of Wasco county, who was serving out a term of three wars, commencing October 16, 1886. for larceny iu a dwe.l ng, was allowed his liberty on account of good conduct and a belief that his punishment had been commensur ate with his crime. This pardon is conditional ou his leaving the state. J. P. Cogsdill, an eighteen tnnnths man sent up from Multno mah county, for horse stealing, was given his l.herty upon the rec omeudatiou of the district attorney who prosecuted him aad the judge! who pronounced the s-entence against him. He had served out j about a year of his sentence. The sentence of Harry Smiley, sent up from Multnomah county, February of la-t year, to serve out eighteen months for larceny, was commuted ou account of a strong doubt of his guilt expressed in a large petition. The Salem Vidette is responsible for the following: Miss Mattie Allison, who was the cause of the Saunders-Campbell homicide in Albany, wnioh sent Campbell to his save and Saunders to the pen itentiary for life, fell into a little good luck not loug ago, which proved in a certain sense that si lence is golden. The story would not have been told had not a party concerned let it out as a joke on himself. A few days ago John Frieze, a wealthy rancher and stockman of Linkville, was on the overland train for Salem and before he reached Albany he left his4 seat for a few minutes, during which time the train reiched that station. Miss Allison entered and took the seat temporarily vacared by Mr. Frieze. The gentleman returning and seeing his place occupied by i he iady, dropped into the one be hind her. He was surprised to find iu hisjiew seat a purse con taining about $300 in gold, and trom some inipuise lor which he coujd never account, except a de sire to be gallant, he leaned for ward and said : "Madam is this your pocketbook?" The lady, whom Mr. Frieze afterward learned was Miss Mattie Allison, withoutreply mg took the purse and put it iu her pocket. After leaving the train at Salem Mr. Frieze began think ing about the incident and remem bered that the lady hud not been in the scat where the purse was found and could not have dropped it there, but it was too late then to correct tne mistake he bad made, but it gave him a pointer by which he can profit when he again finds himself sandwiched between 300 and gallantry.
