The following tells its own story: Tbe authorities are practically unanimous in bolding that when it appears that the fundamental law, that ia, the conslitution, has not been obeyed, in the respect* wherein it provides that the constitution may be amended, it is clearly tbe duty of tbe courts so to declare and to bold amendment invalid. It follows that tbe initiative and referendum amendment was received and acted npon by the Legislative Assembly iu 1899, contrary to the ex press and mandatory provisions of tbe constitution, and tbe result is that it must be and is held to be invalid and no part of tbe present constitu tion. The charter of tbe City of Port land, adopted in 1903, is not affected by tbe initiative and referendum amendment, and is held to be in full force from and after its approval by the Governor.—Extract from decision rendered today by Circuit Judge Cleland, Judges George, Sears and Frazer concurring.
