Smoke Signals " July 1992 - Page 10 ' ' 1992 TRIBAL HUNTING SEASONS & INFORMATION The following information has been taken from the Tribal Hunting, Fishing and Gathering Handbook. 1. GENERAL: Each year the State of Oregon shall issue 395 deer and elk tags (not to exceed 43 elk tags) and 5 bear tags to the Tribe for tribal hunting. "Tribal hunting" shall mean hunting pursuant to a hunting license issued by the Tribe. 2. LICENSE REQUIREMENTS: Any tribal member who wishes to exercise tribal hunting, fishing and gathering rights must apply for a tribal license. Tribal members must have the license in their possession when exercising hunting, fishing or gathering rights as well as the required hunting or fishing tag. The license must be shown to any state law enforcement officer upon reasonable demand if the licensee is engaged in or appears to be engaged in the exercise of tribal rights. 3. WHO MAY ENGAGE IN CULTURAL HUNTING: No person shall engage in tribal hunting except a tribal member who possesses a current tribal license, a valid annual hunting sticker and the appropriate deer, elk or bear tag issued by the Tribe. Any tribal member who is by Tribal, State or Federal Law, prohibited from having in possession, or using a firearm shall not be eligible for tribal hunting tags for those hunts which would result in a violation of that prohibition. 4. ELIGIBILITY: No hunting license or tag shall be issued to any young person between the ages of 12 and 18 unless that person possesses a safety certificate approved by the Fish & Wildlife Department. Any State Hunter Safety Certificate is deemed to be an approved safety certificate. The person must have the certificate in his or her possession while hunting. No hunting tags shall be issued to any person below the age of 12 under any circumstances. 5. SEASONS: The seasons for tribal deer, elk and bear hunting shall be those prescribed by the State for all citizens. 6 STATE REGULATIONS TO APPLY: Weapons, antler regulations, methods of taking and other state regulations about taking shall apply to tribal hunting by tribal members. 7. STATE TRESPASS LAWS TO APPLY: State Trespass laws and other laws governing rights of landowners and tenants shall apply to all tribal hunting. 8. TAKING OF OTHER THAN DEER, ELK OR BEAR PROHIBITED: There shall be no taking of animals other than deer, elk or bear as part of the tribal hunting privileges. 9. NO COMMERCIAL USE: No deer, bear or elk taken with a license issued by the Tribe can be used for commercial purposes. 10. NO STATE TAG WITH TRIBAL LD. CARD: No tribal member shall purchase a state deer, elk or bear tag to use with their tribal hunting license. Tribal hunting privileges are valid only when a tribal hunting license is used with a deer, elk, or bear tag issued by the Tribe. 11. HUNTING OUTSIDE THE DESIGNATED AREA: The taking of deer, elk, or bear in a geographic area other than the established tribal "hunting and fishing" area, (Trask Management Unit), is prohibited. 12. TAGS: All tags will be issued from the tribal office during regular office hours (8:00 am to 5:00 P.M. - Mon thru Fri.). If you are unable to pick up your tag during these hours call 1-800422-O232 to make other arrangements or you may request your tag or tag applications by mail. All tags will be mailed by CERTIFIED MAIL ONLY and if returned by mail must be sent CERTIFIED to Fish & Wildlife Dept 9615 Grand Ronde Rd. Grand Ronde, OR. 97347. 13. TRANSFERABILITY: A tag may be transferred by the tribal member to whom it was issued to another LICENSED tribal member, how ever, the first tribal member is still responsible for return ing the tag or reporting the status of the tag. Any unused tag shall be returned to the Fish & Wildlife Department for re-issuance. Tribal members who transfer a deer, elk or bear tag to an unlicensed or suspended tribal member will be subject to penalties. 14. REPORTING: According to the agreement between the Tribe and the State, the Tribe is required to submit an annual fish and wildlife report to the Oregon Department of Fish and Wildlife. Therefore tribal tags and receipts for non-kills, tag receipts with the kill information section completed for those who successfully fill their tags and all reports of lost tags must reach the Tribal Fish & Wildlife Program within the established deadlines. Deadlines will vary due to hunt schedules. Remember, that failing to return your tag, report kills, or lost tags could result in other tribal members not being able to hunt and may also result in penalties. Whenever a deer, elk or bear is taken with a tag issued by the Tribe, the tag shall be promptly affixed to the animal. The information listed on the tag shall be reported to the Fish & Wildlife Department within one working day. 15. RETURN DEADLINES: Deer - (muzzleloader, general & bow) 72 hrs. within end of respective season. Elk - 24 hrs. within end of all seasons. Bear - 72 hrs. within end of season. Lost Tags - must be reported immediately. ALL RETURN DEADLINES WILL BE STRICTLY ENFORCED!!! PLEASE CHECK YOUR TAG RE CEIPT CAREFULLY FOR THE RETURN DEADLINE. The Fish and Wildlife Department will be issuing 345 deer, 44 elk and 4 bear tags to eligible tribal members for the 1992 hunting season. The following guidelines have been adopted by the Fish and Wildlife Committee to give as many tribal members as possible, the opportunity to use their hunting privileges. Please remember that you must still follow State hunting laws, seasons and bag limits. Tags issued by the Tribe are only valid in the Trask Management Unit (consult your Hunting, Fishing & Gathering Handbook for description). The tribal handbook has been revised so if you haven't received your 1992 edition please call the tribal office and request that one be sent to you. The number is 1-800-422-0232. Annually, the Fish & Wildlife Department shall publish hunting tag application forms in the tribal newsletter. Please read all regulations carefully. If an application for a tag is filled out improperly or has not reached the Fish & Wildlife Department before the cut off date, it will not be considered valid and will not be entered into the tag drawing. The deadline for submitting tag applications is AUGUST 10, 1992, 5:00 P.M.. The drawing will take place on AUGUST 11, 1992, 6:30 P.M. AT THE COMMUNITY CENTER APPLICATION GUIDELINES The following hunts require that you fill out the appropri ate tag application form: Bear (4 available tags) Bow Elk (10 available tags) First Season Elk (26 available tags) Second Season Elk (14 available tags) ControlDamage Elk (12 available tags) In order to apply for tags or hunts that require an applica tion form, tribal members must do the following: Complete only one application per category. Multiple applications will result in ALL applications being invali dated for the individual. All applications must be completely filled out and into the Fish & Wildlife Program by 5:00 p.m. August 10, 1992. Any applications received after the deadline will not be considered for the drawing and will be put in the applicants file. This will include incomplete tag application forms. Tag winners will be selected and announced at a public drawing to be held at the Community Center on August 11,1992,6:30 p.m.. If you are traveling from out of town to pick up tags, please call ahead to make sure someone will be available to issue tags. You may also request your tag by mail. Send a note requesting that the Fish & Wildlife Dept. send your tag by mail. All tags will be sent by certified mail only. Any tags returned by mail must also be returned by certified mail. The Fish and Wildlife Deptartment will not be responsible for "lost tags". Winners will need to pick up their tags in person. Tags will be available during regular business hours, (Monday thru Friday, 8:00 a.m. to 5:00 p.m.) or during the Pow-Wow from 10:00 a.m. to 1:00 p.m. on Saturday August 15th.
