T hey fear th a t the government's position could affect th o u san d s o f o th er companies. “T he governm ent’s posi tion would have the effect of making contracts illusory by giving it a b ro ad rig h t to refuse payment at the stated price for services rendered,” the chamber said in a brief to the Suprem e C ourt last year. Even as the BIA and the IHS move slowly to resolve o u ts ta n d in g claim s, th e Obama administration asked Congress for perm ission to impose spending caps on in dividual contracts. The pro posal is opposed by tribes and members o f Congress from both parties. “They are not going to be able to sustain this position either legally or politically,” Rep.
