Non-Indian firms concerned
about tribal contracting dispute
N on-Indian com panies
are hoping that the federal'
government's refusal to fully
fund tribal self-determ ina
tion contracts w on't affect
their industry.
Tribes and Alaska Native
corporations have won two
m ajor decisions from the
U.S. Supreme Court. But the
B ureau o f In d ian A ffairs
and the Indian Health Ser
vice still owe an estimated $2
billion in contract support
costs.
“Can you imagine telling
your landlord, ‘Sorry, I ’m
only going to pay you 80 per
cent o f the rent this month?’”
N oni Manning, the form er

Shoshone-Paiute Tribes, one
of the tribes involved in the
Supreme Court litigation, told
The Washington Post. “In the
.rest o f the world, a contract
is a contract.”
N on-Indian interests, in
cluding the U.S. Chamber o f
Commerce, have supported
tribes in their bid to receive
full funding for their coft-
tracts. T hey fear th a t the
government's position could
affect th o u san d s o f o th er
companies.
“T he governm ent’s posi
tion would have the effect of
making contracts illusory by
giving it a b ro ad rig h t to
refuse payment at the stated
price for services rendered,”
the chamber said in a brief
to the Suprem e C ourt last
year.
Even as the BIA and the
IHS move slowly to resolve
o u ts ta n d in g claim s, th e
Obama administration asked
Congress for perm ission to
impose spending caps on in
dividual contracts. The pro
posal is opposed by tribes and
members o f Congress from
both parties.
“They are not going to be
able to sustain this position
either legally or politically,”
Rep. Tom Cole (R-Okla.), a
m em ber o f the Chickasaw
Nation, told the Post o f the
proposal.
an earlier agreement.
T h e new co m p act, a p
p ro v ed by law m akers and
signed by Gov. Deval Patrick,
spells out a variety o f terms
including how much in gam
bling proceeds Massachusetts
would receive should the tribe
succeed in its plan to open a
resort casino in Taunton.
T he state w ould get 17
percent o f gambling revenues
if the casino is the only gam
bling facility in the southeast f
region; and 21 percent if it's
the only casino in the state.
The tribe must still clear a
potentially greater legal hurdle
o f securing federal land-in-
trust approval.
