Administrator Mark Johnson ■said the dig will start this spring, as p a rt o f the environm ental assessm ent process. “We w ere n o tified o f th e possibility that there may be an In d ian b u rial g ro u n d o n o u r site,” Jo hnson said. “We have learned that the dig m ight take anywhere from 30 days to 90 days.” T h e construction site is next to the existing L isbon veterans h o m e, is n ear th e S heyenne River. “It used to be kind o f the old riv er b o tto m an d th e river's changed its way. Lawyers spar over tribal police brutality lawsuit SIO U X FALLS, S.D. (AP) - A judge has been asked to dis miss a police brutality lawsuit filed by a 70-year-old American Indian m an on grounds it be longs in tribal, not federal, court. F ran k Sioux B ob o f P ine Ridge said in the civil com plaint that on July 21, 2005, he was at h o m e w ith his grandch ild ren w hen officers entered the house a n d in d ic a te d th e y w ere r e sponding to a call about a gun. T here was no w eapon in the house, no one in the place had m ade such a rep o rt and the of ficers entered w ithout a w arrant o r consent and roughed him up, the lawsuit states. T h e officers were employed by the Oglala Sioux Tribe's P u b lic Safety C om m ission but, the d e fe n d a n t in th e case is th e U nited States governm ent. In M arch 2006, Sioux Bob filed a claim fo r a $350,000 settlem ent w ith the Bureau o f Indian Affairs b u t n o action has been taken, so he took the case to court to seek damages. U.S. A ttorney M arty Jackley argued in co u rt docum ents that th e case should be dism issed because tribal officers are n o t authorized to enforce federal law so the case is in the w rong jurisdiction. Sioux B o b 's lawyer, T erry Pechota, countered that the law suit does belong in federal court and a decision should n o t be made until a hearing is held and the defense receives m ore evi dence.
