Spilyay Tymoo Page 3 Judge says don't count hatchery fish w ith wild (JLP) - .A federal judge ruled the government does not have to count hatchery salmon along with, wild fish when deciding whether to protect a species. U.S. Dis.trict Judge Michael Hogan in Eugene denied a law suit brought by property rights advocates, farm groups and de v e lo p m e n t in te re s ts ag ain st N O A A Fisheries. T h e lawsuit challenged all 16 listings o f West Coast salmon under the Endan gered, Species, Act. Sonya Jon es, an attorney for the Pacific Legal Foundation, whiyh brought the lawsuit, said it was disappointed, particularly because in, 2001 Hogan ruled in fa v o r o f i t s arg u m en t th at N O A A Fisheries could not pro- tect^dld O regoncoastal salmon as a.,threatened species i f it did not protect hatchery fish in the same population group, “T h e debate over hatchery fish should be considered con clu siv ely o v e r,” , said Ja n H as$elm an , an atto rn e y fo r Earthjustice, which represented conservation groups interven ing on the side o f the govern ment. “T h is judge in 2001 gave them an inch and they tried to take a mile, i t didn't work. So now the debate's over.” The 2O0l ruling ultimately led to a new federal policy on using hatchery fish to rebuild dwindling salmon populations and taking O regon coastal Coho o ff the threatened species list. T. “We believe this is an unlaw- fid interpretation o f the way the hatchery policy was applied to these 16 populations,” Jones said o f the latest ruling. “We will be appealing it.” T h e legal debate is not over.
