The code provisions can be ■ used by the Tribal Court in de- ! ciding cases that may arise in- ! volving sales or leases of goods. People involved in a sale or * lease transaction on the reser- ; vation can also avoid any mis- understanding by referring to the , code provisions, which are now * chapters 720 and 721 o f the ■ Warm Springs Tribal Code. The p ro v isio n s o f these codes are based articles of the U n iform C o m m ercial Code (UCC), which guide transactions in state jurisdictions. Last week, commercial code chapters w ere p resen ted to ' T rib al C o u n cil by a tto rn ey ! C in dy S tark e, o f K arnopp ! Peterson, and Lonnie James, of the Warm Springs Chamber of Commerce. The purpose of the chapter ; on sales of goods is stated as ' follows: To establish and clarify the rules governing contracts for \ the sale of goods in the tribes’ jurisdiction; to support and en courage economic activity and investment on the reservation; and to make uniform, so far as possible, the law among this and other jurisdictions. The purpose of the chapter on the lease of goods is similarly stated. The chapters apply only to sales and leases of goods, not services. Parties to an agreement may vary from the provisions of the code, when they do so by mu tual agreement. However, pro visions requiring that contracts be perform ed in good faith, with diligence, reasonableness and care cannot he disclaimed by the parties. The Council vote on approv ing the code provisions was six in favor, and one abstention. The provision had been sub mitted to public comment, and there were public meetings dur ing which tribal member com ment was recorded. The UCC project is next to move on to a chapter govern ing secured transactions involv ing collateral. Young Achiever LaRonn Michael Katchia Sponsored by Les Schwab Brian Mortensen/Spilyay Shaw honored Nat Shaw, recently retired public relations official for the Confederated Tribes, observes a plaque given to him at a farewell luncheon at Sonny’s Restaurant in Madras last week. The plaque announced that the on-air control room at KWSO radio would be named the “Nat Shaw On-Air Control Room,” as he was honored as “the man who brought radio to Warm Springs.” Shaw also received a blanket at the luncheon, attended by members of the Tribal Relations branch, which includes the Spilyay Tymoo and KWSO. Shaw and his wife Mavis, a tribal member, live on the Warm Springs Reservation.
