Even now, nurseries are begin ning to stock up on new plants and shrubs for the upcoming growing season. In some areas, roses already show new growth and a faint hint of a bud can be seen on some flowering trees. If planting a new tree seems like a good idea this year, a little advanced planning could save time, money and ultimately the inconvenience of be ing without electricity due to contact with overhead or underground power lines. It is in bad need to be reformed. You would think if a person wanted to practice law he or she would be required to pass the state bar exam. There are other tribes throughout the Pacific Northwest who require the judges, prosecutors and public defenders to be registered with the State Bar Association. As of now Warm Spring is the only tribe that does not require the judges, prosecutors and public defenders to be registered with the State Bar Association. The Bar Exam is the final test to be past in order for a law student to practice law legally. When the Warm Springs tribe allow s this to happen it not only threatens the tribes standing as a sovereign nation but it also hurts the people emotionally. A wheel barrow appeared to be poised for anything but snow. Robert Wood Johnson update Well, we just got back from San Francisco! I've never been there before and it was pretty fun. The Robert Wood Johnson Foundation that funds Healthy Nations brought together all the grantees, from the Colvilles to the Cherokees of Okla homa, 15 groups in all. We learn from each other, learn how to get an alcohol and drug prevention-treatment program up and running, and figure out what's ahead from the Foundation. Once I got past airport security, who thought Russ Alger's laptop computer was a bomb because I couldn't turn the darn thing on, the trip got a whole lot better! First of all, we're going to be running a behavioral risk factor sur vey, like they did in 1990, and there's a $500 prize for a man and a woman to those who participate. The survey means you sit down with someone from our community for an hour, answer confidential questions about your health, and your name is entered in the drawing. It'll run March to May, and if you have any questions, just give me a ring. After that, it's time to wrap up our needs assessment, figuring out what our community needs, phase and get In the white man's world this is called "organized crime." The people of this tribe have the power to make the changes that are needed to set the system right. Make it mandatory for the judges, prosecutors, be registered with the "Oregon State Bar Association," make the tribe hire lawyers who are registered with the Oregon State Bar Association to be public defenders so when a person is to stand trial you are given the civil right to adequate council, not just left with legal aide department. If this t:ibe is truly to be a sovereign nation it needs to get caught up with the rest of the world. A lot of the cases that are handled in the tribal court should be sent to the federal court in Portland. The Tribal Court wants to be recognized as a "Federal Court," but in the Federal Court system the judges, prosecutors and lawyers are all members of the Oregon State Bar Association. So if the Tribal Court wants to be a Federal Court than why not follow the Federal Court "2- lw - - V; ' onto the action part of this project. We have community meeting sched uled for the first week in March at each longhouse, and this will be your opportunity to put in your ideas and thoughts on what we need in the community. Remember, we're look ing for groups of community mem bers who say they've got a great idea or two to reduce alcohol and drug abuse on the reservation to stand up and say, given a little support, we can get the job done. We're open to ideas outside of the normal program "maih' stream." We're interested in local community groups who can takii charge, and I'll help out with tho paperwork stuff, but it be your shove We've got four years to really try some new and inventive ideas. Finally, I'd like to ask you another question: Do you think our commu nity laws and norms are favorabfe towards drug use, firearms, and crime? What's been your experi ence? In this tribes court system a person is guilty until he or she proves themselves innocent. That is wrong to let this happen. When the justice system is run in this manner it will give the Government a reason to come in and take the power away from the tribe to govern itself freely. Because the tribe is allowing its people civil rights to be violated repeatedly. The only way to keep this from happening is to reform the tribe's justice system, set similar guidelines as State and Federal Courts follow By setting these guidelines the tribe would be protecting the civil rights of its strongest resource, "the people By protecting the people's "civjj rights" it would be making this trib$ a stronger nation.
