S, Supreme Court pending decision on an ap peal of his income tax evasion sentence. The 65-year-old Costello ap peared thin and his voice was husky and quavered as he stepped out of the Federal House of Detention last night. He said he was "going right home" to his apartment on Cen tral Park West and his wife Lor etta. ' Costello has sworn in various appeals courts that he is suifering from cancer, heart disease and ulcers. He told newsmen last night that he had lost 15 pounds and had had a cold for three monlhs. His counsel, Edward Bennett Williams, flew here from Wash ington with a copy ol Monday's Supreme Court release order. Costello has served 10 months of a five-year prison term im posed for evading $28,532 in fed eral income taxes for 194B and 1949. He also was fined $20,000. Williams contends in the appeal that his client should have been sentenced, under a section of the law that specifies the evasion as a misdemeanor, and says the sentence should not have been more than one year and the fine no more than $1,000. Costello was sentenced under a section that prescribes his evasion as a felony. Senate Opens Banking Laws Change Debate j WASHINGTON Wl - The Sen ate begins debate today on a proposed general revision of the nation's banking laws. The product of -lengthy study by a banking subcommittee, the changes to streamline and codify banking laws are set forth in a 251-page bill. A 111-page report by tho committee provides expla nation of the changes, many of them highly technical. It is the first such revision since 1935. Among other things, the meas ure would set (tp stricter controls over bank mergers and over pay ment of dividends by national banks. Other major provisions would make cumulative voting by stock holders for bank directors permis sive instead of mandatory, per mit national banks to issue pre ferred slock under strict govern ment supervision, and restrict federal savings and loan associa tions from opening new branches in 24 states. The measure also would direct federal supervisory banking agen- j cies to establish ground rules gov erning the hiring of their em employes by banks, simplify and standardize bank reporting ' re quirements, require disclosure of bank stock ownership, and take away the rarely used power of Federal Reserve banks to make commercial and industrial loans. Wl Missouri's Legislature completed action yesterday on a bill giving the Stte Division of Health great er powers to regulate nursing homes. Just 23 days ago fire swept through the Katie .lane nursing home at Warrenton, Mn and 72 of its 155 elderly i residents , per ished. It was the worst nursing fire in the nation's history. Its cause still is not delcrmined. Gov. James T. Blair outlined plans for a new bureau in the Division of Health to administer and enforce nursing home regula tions. He fired the health direc tor soon after the fire for failure to take vigorous action. Gore Vidal, author ol the Broad way hit comedy, "Visit To A Small Planet," was born at the United States Military Academy in 1925. Despite this Army beginning, he was first mate on a Navy trans port in World War II.
