By thfi Pipes opinion, handed down January 2 last, the court reversed the lower court for Benton county -wnere McDanlel was convinced of having liquor tn his possession. By the Belt opin ion, which followed a rehearing ot the case, tito supreme court re-vcrue-j itself and upholds the lowr court. The Tipes opinion held that ."or an officer to search a man with otu a search warrant, merely as an incident of an arrest for some crime, the man searched must nt the time he lesally a prisoner of the officer. This opinion held while an officer may make an ar rest for a crime committed in his presence, he may not, witho.it search warrant, previous to the arrest, search tho person for In strumentalities of the crime, thmish having probable causo to believe the person has them. The Pi pas opinion held that a search without a search warrant, to he loRal, must follow and not precalc the arrest, and that mere restraint for purposes of the search is not an arrest. An opposite view ie taken by the Belt opinion In these words: "It Is urged that the arrest followed, and did not precede, the search.' In our opinion It Is imma terial whether the arrest proced ed or followed tho search if such acts were practically simultane' oils, and if, in fact, the defend ant was guilty, of committing a crime In tho presence of the of ficers for which he might have been arrested. In many iiifitances it is dangerous for an officer to go through the formality of stnt ing that the accused Is under ar rest, and the law does not require him to do eo. It is often times safer to act first and talk after ward." The Belt opinion eays fur ther that "In (he instant case the defendant was legally arrested and searched, and thp evldenco of his crime was ndmfssable to es tablish his guilt. The trial court erred In holding tho search and seizure unlawful, but since the ruling favored the defendant he is in no position to complain." Another point of difference in the opinions Is this: The Pipes opinion holds that the fact that a deputy sheriff "smelted whiskey on the defend ant's breath; that his overcoat was buttoned awry; that his face was flushed," was not evidence that the man had liquor In his possession, "They (the officers) were willing to arrest the defend ant to answer for the crlm eo having liquor In his possession when they could produce no di rect evidence to support it," says the opinion. On the other hand the Belt opinion holds that the officers, from personal knowledge gained through their senses, had the right to draw the reasonable In ference that the defendant had intoxicating liquor in his posses sion nnd that he was attempting to drive an automobile while in a drunken condition. The Belt opinion holds that without doubt ho was committing a crime in the presence of the officers for which they had a legal right to make arrest without a warrant, and the riRht of search followed as an incident thereto.
