Ivai Murphy, serving a jail (sentence in lieu of payment or. a &0 line must servo hie allotted time in the county jail or pay the entire fine. Judge Percy R. Kelly decided In the circuit court after hearing the arguments of Tob Garland, reprc senting Murphy, and District At' torney L. O. Lewellinc, represent' ing Sheriff Richard, over a peti tion for a writ of habeas corpus for Murphy, Judge Kelly, in denying the writ, ruled thut the law makes no provision for credit on a fine pay ment for time served by a prisoner in the county jail. Murphy alleged that ho had served 99 V4 days in jail, and should accordingly be given credit lor f 199. He had of fered at tho end of the 99 V4 days to pay (301 of the fine. Sheriff Richard has refused to accept this part of payment of the tine, re . quiring, upon the advice of the district attorney, tnat Murphy pay 250 ditva. Judas Kelly thus upheld tbo district attorney in his interpreta tion and Sheriff Richard In his execution of the law. Murphy, through his attorney, has filed notice of appeal to the tftato supreme court. He furnished $500 appoal boiiu and ha been released pending final decision by the supreme court. When this question is decided ft is said, many counties In Ore gon In Oregon will be compelled to change tactics if they comply with the law. BARN NEAR SILVERTON DESTROYED BY FLAMES Silverton, Or.," June 24. The barn of L, Prcdcck. whose home is about four miles east of Silverton, was coc:nletely destroyed by fire Monday night. Not only was the building burned but also eome hay, abort 0 cords of wood, a clover huller, a tractor and a num ber of other farm implements. The loss of the barn and contents, none of which, according to re port, wag insured, was estimated at about $7000. No animals were lost in the fire. West Salem, June 24 The trial ,1 Frank Einfeldt, who was rested lost week for poisoning two German police dogs belonging to George Aschenbrenner, haa been set for next September. One belief prevailing here is to the effect that the dogs died as a result of eating salmon scrape which Einfeldt fed to his chickens, Einfeldt is in tne habit of bring ing raw salmon scraps from Sa lem and scattering them in his chicken yard. It is believed that the dogs, wandering from Aschcn brenner's property, located only a few yards away, picked up some of the scrais and died as a result. Einfeldt is quote as denying em phatically that he placed any poison in tne sera ps, or in any other food for the doga to cat. lie intends to fight the lawsuit brought by Aschetibrenner, to a finish. The two men live 7 blocks west of the West Salem gravel plant. Webb of this city, sustained some very painful bruises in a runaway, while driv- ng throush town with a hay rake. While appioacliiug the bridge near the Poi'tland-unmascus cream station the horse started to run. The bridle became unbuckled and allowed the bits to come of the horse's mouth causing the boy to lose control ot the horse. The rake truck the bridge railing, causiag the shafts to break loose, allowing tne horse to run on down the street where it was caught. The impact- threw the boy to the ground. Miland, operators of small sawmill In the Willamina district, were fined $25 each by Justice of the Peace Coad, Tues day, on a charge of taking im proper precautions to prevent fires at their mill. They were said to havo had no spark arrester, refuse burner, or fire fighting equipment. The arrest was made Monday by fire wardens. MONMOUTH CONSTABLE ANSWERS DAMAGE SUIT Dallas, Or., June 24. W. J. Mulkey Jr., constable of the Inde. pondeace-Monmouth district, dix tendant in a $10,000 damage suit brought by Mrs. Arkie Pugh, filed his answer to the suit Tuesday through his attorney, Oscar Hay. ter. Mr. Mulkey declares that any injuries sustained by Mrs. Pugh were brought about by her at tempt to prevent the recapture of Walter Godscy, who attempted to break away from Mr. Mulkey, who had taken bim In custody on fc larceny by bailee charge. Mulkey's answer declares that Mrs. Pugh attempted to hold him after Godsey broke away and that he freed himself after ordering her. to let go.
