RETURN OF BANK OFFICE MANDAMU S Capital Journal Calls On District Attorney To Compel Compliance With Law In Matter; The Capital Journal today made formal demand upon Joliu H. Car-, on, dtatrict attorney for Marlon county to take mandamus action to compel the return of the main office of the state banking depart ment to the state cuptial in ac cordance with the law which re quires that the department main tain Its offices In Salem. The demand Is made by George Putnam, editor cf The Journal, as s taxpayer, and the mandamus sought is to b erected at Frank C. Bramwell, state bank examiner;, the state banking board, and Sec retary of StaU Kozer, Recently the main office of the state banking deportment was re moved to Portland on the stated xcuse that it could be .more eco nomically conducted there, and Mr. Kozer stated that H was prob able that Mr. Bramwell would maintain "desk space' in the Cap itol to comply with the terms of the law. San Francisco , April 6. Short ly before noon today the defense closed Its case to prove Dorothy Eltingson Insane, and the prosecu tion began Its effort to establish mental competence In the 17 year old girl, who killed her mother last January 13 In a quarrel over the girl's devotion to the night life. While Dr. Jau Don Ball, a de fense alienist, was being cross- examined the better part of the morning, the girl, displaying per fect composure, smiled broadly at some of the psychiatrist's- state ments and sometimes shook her head emphatically. The defend ant, recovered from 'the serious state of hysteria that brought on a dozen fainting spells last week, folded her hands calmly and fol lowed the testimony closely. Once when a data was mentioned, she turned around and studied a cal endar on the wall beside her. Prosecution Opens In a very brief opening state ment for the prosecution, Assist ant District Attorney Harmon D. Skidlln said he expected to estab lish that the girl was sane. He promised to prove that she was not a "pathological liar" an contend ed by her attorneys that the X- ray photographs Introduced In evidence did not show abnormal ties In the teeth and head, and "established nothing." Murder Xutv Excused The jury In the murder case, which Is Interrupted by the sanity trial, was excused today for one week. - Questioned by Assistant District; Attorney Harmon D. Skillln, Dr. Ball said It was "impossible to define Insanity." He added that roughly it was "any deviation from the normal." Under further questioning, Dr. Ball said he did not apply the "right or wrong" test to patients because It entered the field of philosophy and was not of Interest to the psychlastrlst. He contend ed that medically there was no such test. Asked whethter the girl under stood of what she was accused the alienist said she "apprehends It, but does not comprehend It In all Its relations to society." Interrogated further he said he believed the girl could tell her attorneys what happened before January 13 (the day her mother was slain) and the events since. Convinced of Insanity The witness said he definitely formed the opinion of Insanity the last time be saw her In Jail, when she slammed down a chair, cursed and left the room In a rage. The girl, decidedly more calm than on previous days smiled at this testimony. .Dr. Ball also conceded that the defendant seemed to be In good physical condition, but added that psychiatrists were more con cerned with conduct, in the ab. sence of any organic disturbance that might cause abnormality. Mr. Skillln concluded his cross examination shortly before noon. The defense then rested, and Mr. Skillln made hie opening statement. He said he expected to establish that the girl was not "a patholog ical liar," that the X-ray pic tures Introduced In evidence "es tablished nothing." He promised to show that the girl was sane.
