JO. - The special grand Jury which will take testimony in the new pro ceedings here in the case of Sena tor Burton K. wheeler or Mon tana unexpectedly was called up on today to reopen consideration ot the naval oil leases. Atlee Pomerene and Owen J. Roberts, 'government oil counsel, appeared before the jury when It convened and Judson C. Smith and A. 8. Booth, officials ot the First National bank ot Pueblo. Col.o., were examined. No indica tion of the testimony expected was given. A similar Inquiry was held be fore a grand jury hers last sum mer, but no report was returned. It to provided, however, that if in the proposed territory there la an entire county or counties, or an entire Incorporated city or cities, and any such county or city should register a majority vote against the Incorporation, thon such county or city voting nega tively is deemed to have rejected the formation of the municipali ty, ana is not Included in tho mu nicipality formed. The governor appoints the first trustees ot the municipality, who serve until tho next general election, voting and appointment to which general election the municipality elects us own trustees. The trustees under the propos ed measure are given authority to sell the bonds ot tho municipal ity in an amount not to exceed $15,000, for the purpfiso of pro curing tlio necessary funds to make the initial surveys and de termine the probable cost of the development of either water for domestic uses or water and hy dro-electric power. After deter mining the probable cost of such projects the question It submitted to the voters of the municipality to determine whether or not the bonds of the municipality shall be sold for the purpose ot the wa ter or power development. The municipality is given au thority under the provisions of the bill to do anything necessary in order to furnish the lnhabl tnnts of the municipality water to live in incorporated cities or In others, for domestic purposes, and electricity for either light or power purposes, dependent upon the extent to which the munici pality may determine to engage in such activities. The measure further provides that the trustees shall fix and determine the rates to be paid by the users of such water or power and such rates must be sufficient to maintain the necessary equip ment to take care of depreciation, pay all of the overhead expense, th. Interest on bonds and retire the principal. Other than the limit of $15,000 no bonds ran be sold by the trus tees without the vote ot th, legal voters of the municipality. While the occasion tar legisla tion ot this kind at this time has arisen with respect to the needs of the four valley cities, namely, Salem. Albany.
