Marvin Calkins, the third youth to face a statutory rape charge, was convicted, the jury deliberat ing for about an hour and a half. Testimony developed that Calkins had married a Sheridan girl in dependence, took her to her home and returned to hie home near Airlle the night before the data in which he was charged with the crime against a 14-year-old Airlle girl. Samuel H, Tctherow, aged 89 years, died Weduesuay at hi home In Dallas following an illneaa of several months brought oa by a fall. Mr. Tetherow was one of Polk county's earliest pioneers. He crossed the plains with bis pir ents in IS 45. a boy ot nine years. Ihe family spent the first winter cu the present townsite of Dallas, where there was just one log cabin and In the spring took up a donation land claim on the Luckiamute near the Junction of the big and little Luckiamute riv ers. When the Indian troubles came on in the 60's, Mr. Tetherow en listed and served under Captain Hayden durins 1855-6. in what is now the state ot Washington. Only one member of the old company. Da vo Hedge of Independence, survives. Mr. Tetherow woe born In Pike county, Missouri, March 6, 1836 He is the lust of a family ot seven to pass on. During his entire ac tive lifetime he wae a farmer iu the Luckiamute country. He served one term as mayor of Falls City. For the past six years he has resided in Dallas.
