guilty Tuesday night by a jury on
charge of stututory rape, was
sentenced to threo years In the
penitentiary by Circuit Jurtce
Ramsey today. The law fixes the
penalty from 3 to 20 years.

Marvin Calkins, the third youth
to face a statutory rape charge,

Testimony developed that Calkins
had married a Sheridan girl in
dependence, took her to her home
and returned to hie home near
Airlle the night before the data in
which he was charged with the
crime against a 14-year-old Airlle
girl. Culkins will up pear for sen
tence Saturday. Frank Coonar,
convicted of the same charge Mon
day, will be sentenced today. The

Tctherow, aged 89 years, died
Weduesuay at hi home In Dallas
following an illneaa of several
months brought oa by a fall.
Mr. Tetherow was one of Polk
county's earliest pioneers. He
crossed the plains with bis pir
ents in IS 45. a boy ot nine
years. Ihe family spent the first
winter cu the present townsite of
Dallas, where there was just one
log cabin and In the spring took
up a donation land claim on the
Luckiamute near the Junction of
the big and little Luckiamute riv
ers. When the Indian troubles came
on in the 60's, Mr. Tetherow en
listed and served under Captain
Hayden durins 1855-6. in what is
now the state ot Washington. Only
one member of the old company.

Mr. Tetherow woe born In Pike
county, Missouri, March 6, 1836
He is the lust of a family ot seven
to pass on. During his entire ac
tive lifetime he wae a farmer iu
the Luckiamute country. He
served one term as mayor of Falls
City. For the past six years he
has resided in Dallas.
Mr. Tetherow is survived by hie
widow and four sons. Columbus
Tetherow, Dallas; King S. Tdthe
row, Wtnlock. Wash.; W. K,
Tetherow, Northport, Wash., find
S. B. Tetherow. The Dalles. His
first wife, aud the mother ot the
children, died 39 years ago Uc
later marired Mrs. L E. Holman.j
