BIOS ON CITY BONDS OPENED TONIGHTS MEET Bids on the city Improvement bonds advertised to be sold Janu ary 19. 1925, will be opened by city recordor Paulson at the meet ing of the city council tonight at 7:30 o'clock in the council cham bers. A new alderman will be elected to fill the vacancy caused by the resignation of C Van Patten of the sixth ward. Damon Fleener was named at an InformaL meet ing of tue council after he resign ed at the last regular meeting, but he must be elected, or some other man bo elected at this meeting. The fact that Mr. Van Patten put in his resignation to take effect at the close of the last regular meet ing prevented his successor's be ing elected then. CHALLENGE MOSER'S RIGHT TO SERVICE (Continued from Pnge Ono) regards the selection of a presid ing officer for their organization or of their disposition as regards the personnel of me Multnomah county delegaticn. Their cho'oc for tho preslocncy hoe already been expressed, and they are cvi dently not Inclined to question the comeptency of Senator Moscr on runtonal grounds. But his retention lu the chair and aa a member of the senate raises a serious question as to the validity of every act of the pres ent legislature, particularly in those Instances whero Hie division in balloting may be close, anl where Senator Moscr casts the ue elding vote. Today the matter of Senator Mofler's eligibility is ono (or th.' senate itself to pass upon. Wioit the session has adjourned nnd the constitutionality ot the legisla tures acts may be Id litigation, then the question becomes one for the court to decide, and precedent throws serious doubt upon wheth cr tho supreme court would held Mosor entitled to hla seat. Rulings of Court. There are lew holdiugs of tti court in the past upon which to base an opinion aa to what the'de cision might be, but thcro are a few canes In point. In the case of Gibson vs. Kuv, C9 Or. P. 6J6, In which a writ of mandamus was sought to com pel tho stuto treasurer to pay a warrant drawn upon the state fiindH for $87.50 in payment lor the service of Claude MeColioca state senator from Baker county. to the corporation department. The court in this case reported two findings which prevented Mc Col loch from drawing tho moiey, one that as a member of the legis lature which created tho corpjri tion department ho was prohibited from receiving compensation from tho department for services, an 1 the other sustaining tho constitu tional provision an regards legis lators holding lucrative offices un der the state government, ana holding that subordinate appJln tlve offices are to bo construed as coming within the inhibition. Court lseciftion The opinion held that the bci creating the- corporation depart ment authorized the corporation cnmmliisinner "to auooint such clerks, stenographers and wU'.' ants as may be actually necessary from time to time to properly alt charge the duties of the office and inasmuch as thi same act provides fur the compen nation of such office. It becomes lucrative office within the mean in of the consttiutlon, and bring him witbin the rule that b can not hold lucrative offices at th.4 same time. "There is a further reason,' the opinion written by Justice BiirJ nett reads, "for not upholding the claimant In the situation I n vol to J It Is said In article 1, section 1, of the state constitution that the powers of the government shall be divided Into three separate depart ments, the legislative, executive, Including the administrative, and the Judicial: ud no person charged with official duties In one of these depart men rs shall oxpp cWie eny oC the functions of n ON THE AIR MONDAY (Pacific Time) KOW M p. m., Oregonlan concert orchestra. 10 p. m., (leorge Olsen's Metropolitan or chostra of the Hotei Portland; Intermission numbers by Bhef ler'i Novelty tit ring orchestra, KFHJ 7-S p. m, O. In anj view of the case the functions ol the corporation commissioner aud his assistants, including sten firnphers and clerks, pertain to the administrative department of the govemuieut in which a m-n ber of the legislative department is forbidden to participate.' MOMr't ftllfrihiliv In the case of Seiiator Moser the question is advanced whether his employ ment as attorney for i ue i-oil oi I'oiiiaufi makes lwn an employe of the administrative branch of the state government, or an employe of a subdivision which Is a legal unit of govern ment in Itself. The supreme court has held the employes of cities unit other independent political units Jo not come within the inhibitions ot the constitutional provision !n quenllon. But attorneys who have studi'd the question carefully are incline to the opinion that the Port of Portland is directly a subdivision ot the state government, druwin ite authority from tho legislutuiu and having its commissioners named by the governor or the leg islature. Senator Mnser as attor ney for the l'ort of Portland Ik just as much on employe of the state as Claude McColloch was an appointee of tho corporation d-j purtinent, these attorneys hold. Subject of Snerulation What action may expected from the seuute should the action o: Mover's eligibility be brought di rectly before it is a matter of ton slderuble speculation. Were nol.'i ing else than a seat and the presi dency involved there Is no ques tion but what he would have practically the uuauimous sup;; of the upper house. Hut if hw presence there is to throw thi le ftality of the legislature's nets into question the situation may be (Mi fcrent. In such a cmti the plan: of his friends us well as his oppj nents would be In Jeapordy. It also miwt be considered that as president of the eenato Sen a tur Mosor would become governor of the state In event of the deatb ir disnblllty ot Governor fierce, nn 1 the question arises as to whether ho could legally oxecuto the d'Jtk of that office. There are a score or more of other interesting possibilities In tho situation, not tbe least of which Is what would deveh p should Senator Moser be unseated and the governor be called upon to name his successor. Confusion nnd ChftOs Existing committee assignment in tbe senate would all be set aildi automatically, what organization now exists would bo seriously shaken, at least, end the seame would be thrown Into a now wrangle over the selecting ot a presiding officer. Such a condi tion would unquestionably shatter all existing plans, and would leave Governor Pierce In a much stronger position than he now oc cupies. In all ot Oregon's legislative his tory there has been only one sun liar case. In tho session of 1870 the senate refused to seat II in ger Herman as senator from luglo connty on the ground that he v. as then holding a lucrative ofile under the federal government that of deputy United States reve nue collector. L. K, Moaner wan seated In his stead.
