TWO JUDGES TO SIT FOR HALL'S CONTEST SUIT In order that there will be no fart ot the law that will be over looked in the primary election Contest, Judge George O. Bing- im ha asked Judge Percy R. Kelly to alt with him at the hear ing. The coming contest is the first of its kind In Oregon never before has a case of magnitude of the one now preaching coma up under corrupt practice act. Both Judges are in Salem and will go Into conference concern Ing the meaning of the laws. for the Judge Bingham said yesterday, "I have read the law but as It has no precedents In Oregon, it will fcave to be interpreted by a close tudy of the facts, and a close study of the law Itself." As to whether the case comes within the corrupt practice act, the judge would not say. He said that he would have to make a more care ful study of the specific law de fining the act. Should the mo tion to dismiss the case be enter ed by the contestee and then a demurrer to the facts follow which would bring the case back to trial, it would be possible to draw the legal contest to some length. The attorneys have not yet announced their plans. Should the contestee win any one of the seven points there will be sufficient ground for having the ballot boxes opened. The bal lot boxes of the suspected dis tricts are under the -control of the court and can be opened and studied only In the court room. No other authority exists to open the ballot boxes. At least three days before the hearing the con testants must file a list ot the persons known to have been fraud tilently or illegally accepted as electors. Whether this or the counting of democratic ballots for republican nominees, the over counting ot the actual ballots as charged In several Instances, or the Multnomah county refusal to allow Hall checkers at the bal lot count, are points that will be up to the two Judges for decis ion. It Is also likely that as the law has never been tested in such a manner before that there will be leaky spots found and It will take the best Judgment of the two Judges to construe the points to the satisfaction of the public. VERA CRUZ IS PLACED UNDER MARTIAL LAW Vera Cruz, Mex., July 7. (By Associated Press) Martial law has been declared here after renewal of the clashes between the police, soldiers and members of the red union of revolutionary tenants. Heron Proal, founder and di rector of the syndicate, is held In the military prison on charges of homicide and sedition. Dallas. Or.. July 7. So far as Dallas Is concerned the railroad' strike did not amount to much. Of the 30 men who were expected to go' out, but one quit, this being an employe of the Southern Pa cific machine shop in this city. Word comes from Portland that It Is expected that practically all the men are yet expected to lay down their tools, but there are no local ndlcatlons of this outcome. The men reported for work the morn ing after the strike was called and have continued to report for duty dally. GRAND RONDE TOSSERS LOSE TO DAYTON NINE Dallas, Or., July 7. On July 4 the Grand Ronde ball team was defeated on their own diamond by team from Dayton, and on Sun day the team ot the Modern Woodmen ot America of Dallas efeated the crack Arleta team of Portland on the diamond at Pa ific City. The Orand Ronde and Woodmen teams will cross bats on the Dallas grounds Sunday, July and a hard-fought and closely contented game Is looked for. IBERTY AND GRAND TO BE MANAGED BY KUPPER Charles Kupper, manager of the Oregon theater, will tomorrow Ight assume charge ot the Lib erty and Orand theaters here, It was learned today. Mr. Kupper will succeed Arthur Laflar, who has been in charge of the two theater and who will re tire temporarily on account of an Illness. The town nf Wendllne near here with a population of 700 was threatened by fire Thursday which burned the big Booth-Kelly sawmill at the town. The mill crew and towns people were reported fighting the flames, which were tanned by a strong wind.
