Limit Applies To Income Taxes Salem, Aug. 21 (IP Oregon's constitutional six per cent limi tation applies to personal income and corporation excise taxes be cadse they are used to reduce the tax levy and not to decrease tne amount of funds needed before the levy is determined, an analy sis of a supreme court ruling showed today. i Chief Justice George Kossman of the Oregon supreme court made this ' point in his opinion ruling that income taxes can oe applied only to reduce property taxes. The question of whether or not the six per cent limitation applies to income and corporate excise taxes has been a long-standing controversy that has plagued legislators, tax officials and tax payers. This is the first time it has been definitely settled by the high court. .The1 limitation is in an amendment tOrtha- state constitution adopted in 1916. It limits a tax levy to not more than six per' cent over the amount of taxes levied in anyone of three preceding years. Explains Opinion This is how Justice Rossman explains his opinion that the lim. itation applies to income taxes. The law oescrimng tne man. ner. which the tax commission must determine state's fiscal needs requires the commission first to prepare a tabulated state ment snowing au items oi ex pense. From tne toiai oi mis laDum- tlon is deducted money in the treasury not applied by law to some special purpose, inis mon ey generally is known as "miscel laneous recemis. The battleground m tne sun was whether or not surplus in come taxes are miscellaneous re ceipts. The high court, in Koss- man's opinion, held that tne sur plus is not miscellaneous re ceipts, but is "applied by law for some special purpose, nameiy to reduce property taxes. Consequently,. Income tax mon. ey available for offsetting pur poses is ueauciea irom uie amount of the tax levy and not from the commission's tabulation of needs before miscellaneous re ceipts are subtracted.
