Church Sued The trial of the case of M. A. Means vs. the First Methodist church of Lewlston was commenced yesterday In the district court, says the Lewlston Tribune. This Is an action In which the plaintiff, on an assigned claim from Contractor Louis Dubrap, seeks to recover the sum of $5,926.91 as a balance due on contract work on the new Metnoa St cnurcn duuuiiik vn Normal hill. The complaint alleges that due to the failure of the church to make payments for the work, the contrac tor was required to drop the contract. His statement of the status of the contract was as follows: Contract price, $18,600; extra work, $1,099.63; estimate of amount necessary to com plete contract, $1500; amount due. $5,926.91. In answer the cross complaint of the church cites that the trustees hold the note of Dubray for $1000; that the church Is entitled to a pen- alty of $20 a day for, 120 days for failure to complete the contract with in the time specified, this item amounting to $2580; that the church Is entitled to a penalty of $20 a day for 120 days for failure to complete the contract within the time specified, this amounting to $2580; that the church is entitled to an additional penalty of $600 representing thirty days' time necessary to complete the work and that the amount of cash paid on the contract is $12,181 These figures show a total ofset of $19,707.33 and the church asks for Judgment for the dlference between this amount and $18,600, the contract price, or $1,207.33. and Is considered one of the prize properties of that district, having a record for cup-winning fruit crops and being located just a short dis tance out of the city limits. The purchasers of this orchard property were Rolond W. Stebblns, HL Morton Holbrooks and the firm of MacRao & Angus. The consideration was approximately $1000 per acre. This figure is considered low In view of the fact that there Is at least $10.- 000 worth of fruit now In sight for this season's crop. The former own er, Mr. Marshall, sold 14 acres of young trees off-this tract last fall for $1250 per acre. The city council surprised many at the meeting last night by refusing to grant Tom Baldwin, the proprietor of the Idle Hour saloon, a liquor license for him to continue his business, says the Baker City Herald. It developed that his license has expired and he will have to close at once. Baldwin's action In beating a drunken man In his saloon and his arrest on the charge of gambling were considered sufficient reasons for refusing the li cense. The vote of the council was a tie. Caldwell's market day was the greatest success of the season, not withstanding the wind and rain which continued almost throughout the day, sayH a Caldwell Item Early In the morning teams began to arrive and before noon the streets were crowded with teams and people Almost every farmer brought In something to sell, and every conceivable article Imagi nable from household and cooking utensils to farm Implements, horses, cattle, sheep, poultry and hogs, were put on the market The number of cattle and horses far exceeded any market day pre vious. Several teams and wagons were sold at a very good figure. Some of the poultry, such as thoroughbred Plymouth Rocks and Rhode Island Reds, were sold for $8 and $9 per dozen. Old vehicles, such as buggies and wagons, sold all the way from $10 t0 $50. The amount of business transacted was estimated at about $4000. Dick ens and Tobias were the autioneers and they were certainly busy men all day. Market day at Caldwell would remind one of a Fourth of July cele bration. People were In the city from all the adjacent towns and coun try and It looks as though market day at Caldwell has come to stay. Doukhobors, the Russian re ligious fanatics who have settled in Canada, has been undertaken and Home sensational developments are xpectcd. It is stated that very few parents ttempt to care for their own child en, but turn them over to the com nunlty to be provided for from the ommon fund. Some of the Doukhobors refuse to bury their dead, believing that the soul f the deceased would bo unable to scape from the grave. Corpses are taken to secluded spots and left to erve as food for the wolves. Physl- lans are not allowed to treat their lefc. the lenders declaring that Jesus i with them all the time nnd that no uman power could serve to avert tho fate of one who is "called." rt Fort William, Ont., the mem bers of an Investigating commission visited a Doukhobor dwelling, which, In their opinion, was large enough for possibly 18 people at the most, but there they found 76 men, woman nnd children, ranging in age from IB to fiO years, lying about the small rooms, nude and uncovered, without the slightest regard for decency or com mon morality. The committee found that these people practice free love, marriage be ing unknown to them. The children born from these promiscuous unions nre cared for out of the common fund. Tn this way girls grow up and be come lost to their own parents at an early age, hecomlng the free wives of the rest of the community. Such conditions were found to exist that steps wero nt once taken to disband Ihe commune, and investigations are being made to determine whether similar conditions exist throughout the Poukhohor villages in Saskatchewan and Alberta. state School Fund Ioans Now Exceed $4,000,000. A Salem paper says of the quarter ly report of State Treasurer Steele for the quarter ending March 31: In the report of State Treasurer Steele for the quarter ending April 1, some interesting figures are given. For Instance, It Is stated that on the state tax of 1908 there has already been received $ 1 04.362.B0. The state tax Is not due until May 1 and Is not delinquent until June 1. The first mortgage loans In the ir reducible school fund for the first time exceeds the four million mark, the exact figures being $4,035,270.51. Late Saturday night news was re ceived from the Cornucopia camp that another rich strike had been made, this time in the Jim Flsk mine and later reports confirmed the story, says the Baker City Democrat The strike Is a five-foot ledge of extremely rich ore gold showing all through and over the rock.
