It affirms I Judge Benson's decision, to the ef fect that though Low was In arrears for three years with interest pay ments the state land board had the power to refuse to accept an applica tion from Hobertson for the samo Innd anii. unon later payment of prin cipal and Interest by Low, did right In issuing the state's deed to Low over Robertson's protest. Tho decision Is of great Importance, being the first to hold that the state land board's decision Is conclusive, wlieiy within the purview of tne law.
