' THE BIGHT TO QUIT IMPORTANT ISSUE RAISED BY WABASH INJUNCTION Brotherhood's Lawyers Contend That Court Has Taken Away the Chief Right of Labor by its Order. St. Louis. March 21. Two argu ments in behalf of the Wabash road were concluded Friday in the injunc tion suit, and the first statement in behalf of the men, by N. F. Judson, of St. Louis, was unfinished when court adjourned for the day. At the opening of court Col Blodg ett resumed his argument in behalf of the company. He read extracts from the constitution of the Brotherhood of Locomotive Firemen to nrCVe his contention that there were no griev ances entertained by the employes against the road, inasmuch as the brotherhood, according to the conten tion, had not proceeded in accordance with its own laws. Its failure to do so, he claimed, showed conclusively that there were no grievances to be redressed. He claimed further proof of this in his statement that the grievance committee had never taken up any alleged grievance. The whole thing lay, he declared, in the recogni tion of the union, and, failing of this, the defendants had conspired to in duce the employes to stop work, and otherwise injure the road. The denial of the oilicials of the two brotherhoods that any coercion had been employed to induce the men to leave the Wabash road was, the speaker declared, not founded upon fact. There are, he said, benefit funds in both organizations to which the men pay monthly dues. There is In the laws of both organizations, he said, a rule providing that if any member declined to strike when an order was issued by the officers, ho should forfeit his membership and pecuniary benefits, and action taken under the fear of losing these was, he declared, plainly coercion. Colonel Blodgett concluded his ar gument at 10:30 o'clock by a general resume of the evidence, in which he declared It was plainly shown that a conspiracy existed to tie up the road and cripple its commerce. Many Voted Not to Strike. He was followed by C. N. Travous, who also spoke In behalf of the rail road. Over one-third of the men, ac cording to the statements of the de fendants, were opposed to the strike, A strike would be In violation of con tract, and U waB ,he said, an unlawful conspiracy against the road. Mr. Travous, In concluding, recited the obligations imposed upon rail roads by the interstate commerce law a federal statute, and urged that Inas much as railroads were compelled to accept and carry freight, no matter by whom offered .and were obliged to offer equal facilities to all connect ing lines, it was their right to have federal protection in carrying out the provisions of the federal laws. At the conclusion of Mr. Travous' argument, Attorney N. F. Judson rose to make the opening argument for tho detendants. Mr. Judson said that at torneys for the railroad had declared that the injunction did not prevent any man from leaving the employ ol the Wabash railroad. He read that portion of the injunction which pro hibits the officers of the union from persuading or coercing the employes of the Wabash road to leave Its serv ice. The right to resign, he declared, is the chief right that labor has, but under the wording of the Injunction the officers of the labor organizations are prohibited from insinuating or suggesting to an employe of the Wa bash that he could better himself by quitting work, as this, he said, was an interference with the right of men to stop work when they choose. There was, he said, no attempt on the part of the two brotherhoods to discriminate against non-union men, and such conduct was foreign to the policy of the railroad organizations. No Attempt to Discriminate. Continuing his argument after the noon recess, Mr. Judson quoted num erous legal decisions which went, he said, to prove that the employes of the Wabash railroad have a perfect right to combine, or to leave its serv ice, or to allow an organization or other men to act for them. No auth orities, he said, had been cited by the lawyers of the road to the con trary. The question of grievances was touched upon briefly by tho at torney, who was passing to other mat ters when he was interrupted by tho court. "You will recollect," said Judge Adams, "that in the bill of complaint it was set forth that there were no grievances, but that false statements were made by the committee to tho effect that such grievances did exist, and that these statements were made l for the purpose of securing recogni tion of the union. Are you going to allow that matter to rest where It is?" "I arn about to discuss It further," said Mr. Judson; and he did so at con siderable length, Rights of Grievance. There is no evidence, continued the attorney. In closing this part of his argument, that the grievances origin ated with the grievance committee, and not with the men themselves, but 1 declare that, if the grievance com mittee felt Inclined to urge employes of the Wabash road to ask for more wages, they had a right to do so. A paper has been icad here, broke in Judge Adams, purporting to bo a Btatoment of the men authorizing this committee to act for them in ne gotiations with the road. I want to see that paper. It was handed up and Judge Adams after reading it through, made notes. Mr. Judson then took up the affida vit alleging a disposition on behalf of the defendants to tie up the Could roads If their demands wore not granted by the Wabash. No such thing was said, ho declared, and no such thing was contemplated. The sympathetic strike Is not sane tloned by tho brotherhoods, and there could not havo boon a conspiracy to tie up the other roads, The history of these organizations Is almost bar ren of strikes.
