Qualified projects must be from no more than 5 years ago, and have direct construction costs of at least $2 million dollars. A mandatory pre-Bid meeting will be conducted on Wednesday, December 21, 2011, at 10:00 a.m. at the City of Wilsonville, 29799 SW Town Center Loop East, Wilsonville, Oregon. Meeting will also include a visit to the project site at 28879 Boberg Road, Wilsonville, OR 97070. The choice of the successful Bidder and/or the rejection of Bids will be announced by January 23, 2012. A contract will be awarded within sixty (60) days after the selection of a qualified Bidder. Award of contracts will not be final until the later of: 1) four- teen (14) business days* after Notice of Intent to Award is given; or 2) the City provides a written response to each timely protest, denying the protest and affirming the award, if the award is affirmed. *Business days means Monday through Friday, except legal holidays observed by the City of Wilsonville. The proposed work for the Wilsonville SMART Ops / Fleet Facility Phase 2 – Building & Site Improvements project consists of furnishing all materials, labor, equipment, and supervision for the construction of improvements, including erosion control, fine grading, paving and construction of an Ops / Fleet Services Building and a Fuel/Wash canopy on an approximately 4 acre site on Boberg Road in Wilsonville, OR. All work is to be substantially completed by November 15, 2012, with final completion by December 15, 2012. The successful Bidder will be required to furnish per- formance and payment bonds from a City approved surety for faithful performance of the contract in the full amount of the contract price. This is a Contract for a Public Works Project ("Contract") subject to ORS 279C.800 to 279C.870 or the Davis Bacon Act (40 U.S.C. 276a), and not less than the higher of the applicable state or feder- al prevailing wage must be paid on this project. In addition, all Bidders shall be compliant with all tax laws. The fee is one- tenth (1/10) of one percent (1%) of the contract price, but not less than One Hundred Dollars ($100.00) or more than Five Thousand Dollars ($5,000.00), regardless of the contract price. In accordance with ORS 279A.110, each Bidder shall certify in the documents accompanying the Bid that the Bidder has not discriminated and will not discriminate against any minority, women or emerg- ing small business enterprise in obtaining any required subcontracts. Each Bid must identify whether the Bidder is a resi- dent Bidder, as defined in ORS 279A.120. The performance of the Contract does not require a contractor or subcontractor licensed to do asbestos abatement work under ORS 468A.720. No Bid for this Contract will be received or consid- ered by the City unless the Bidder is licensed with the Construction Contractor’s Board, as required by ORS 701.035 to 701.055, or the State Landscape Contractors Board, as specified in OAR 137-049- 0230. In addition, a City Business License or a Metro Business License is also required prior to performing work within the City limits. The City reserves the right to reject any Bid not in compliance with all prescribed public contracting procedures and requirements, and to reject all Bids upon a finding of the City that it is in the public inter- est to do. No Bidder may withdraw his/her Bid for a period of sixty (60) calendar days after the date set for opening. When applicable, all Bidding shall comply with President’s Executive Order No. 11246. All Bidders shall comply with the applicable provisions of the Equal Employment Opportunity Act of 1972 and the Civil Rights Act of 1964.
