Supreme Court Upholds Vets9 Right to Occupy Park in Eugene Attempted eviction of war veterans from their temporary housing in trailers at bladden s park, tugene, was thwarted again Tuesday, this time by the state supreme court which upheld Lane county circuit court in denying an injunction sought by property owners cncent to the park. The high court held that the veterans could continue use of the rrk during the duration of the bousing emergency but. not later than Jan. 1. 1948. Number of trailers in the park was restricted to 100. The suit was directed at the city of Eugene, Lane county court, and Willamette post No. 213. Veterans of Foreign Wars. The opinion was written by Chief Justice Harry II. Belt, who said: "It the project involved herein were of a permanent nature, we would have no hesitancy to grant Injunctive relief to these abutting cwners. However, it is clearly es tablished that this veteran hous ing project Is only to be main tained during a public emergency resulting from an acute .housing shortage. It is only a temporary use of the park and does not sub stantially or materially interfere with the purposes for which the fiaik wi,s dedicated. Inconvenience Slight "The inconvenience and dis comfort sustained by the plaintiff abutting owners by reason of this bousing project is so slight com pared to the hardship and injury which would result by the eviction cf these veterans that equity should refuse injunctive relief. It ' i difficult to reconcile the mental attitude of persons whose aesthet ic -nses are shocked by these Sinkightly trailer houses and yet make no" objection to the use of the park as a cow pasture.
