Whether IhU improve ment is an emergency must be determined by the state emer gency board, the attorney gener al held "You set out in your letter," read the attorney general's opin ion, "the conditions which will require more room and facilities in the penitentiary during the present year in addition to those already existing and thus far con structed under the provisions of Chapter 410, general laws of Ore gon for 1929, for the purpose of making alterations, or new con struction either at the former boys training school or the main plant of the penitentiary. "You show that there is a bal ance remaining in such appropri ation of about $35,000. Ybu re quest my opinion whether or not the state board of control has the right, under the law, to ask the emergency board to authorize the creation of a deficiency which would be incurred in the con struction of an additional build ing, after using the present bal ance of the appropriation. "It clearly appears that the em ergency board Is authorized to grant authority to incur a de ticlency is a condition requiring either the expenditure of a great er sum than the amount appro priated by the legislative assem bly, or the expenditure of mon eys not specifically provided by law, "The requirement for the ex penditure of such money must ex ist by reason of the necessity for discharging a public duty Impos ed by law. The check showed that the ex pense money authorised under the 19 2T legislative resolution was re fused bv Representative Miller of Umatilla and Settlemier of Ma rion and Senator Corbett of Mult nomah. It was Indicated here on Thursday that an attempt may be made to recover the expense money paid to legislators under the 1927 resolution. a deficiency. "In the final analysis, the em ergency board" must decide upon the advisability of granting such authority, and ln so doing, neces sarily passes upon the existence of an emergency requiring the same. "In my opinion the facts set out In your letter authorize the state board of control, under the provisions of the statute, to give the notice to the secretary of the emergency board, provided ln sec tion 3009, Oregon laws."
