The state emergency board has
authority to create a deficiency
appropriation to meet any emer

The oofnlon upsets the previous
impression among state officials'
that an emergency appropriation

The opinion was sought or tne
state board of control In connec

determined by the state emer

"You set out in your letter,"
read the attorney general's opin

require more room and facilities

Chapter 410, general laws of Ore

the state board of control has the
right, under the law, to ask the
emergency board to authorize the
creation of a deficiency which
would be incurred in the con
struction of an additional build

ance of the appropriation.
"It clearly appears that the em

ist by reason of the necessity for
discharging a public duty Impos

posed and there are no funds or
insufficient funds available to
meet the expenses of the perform

conditions, the statute authorises
