Sals of Bonds Authorised. B it enacted by the people of the State of Oregon: Section i. The state highway com j amission la hereby authorized, empow- .rears, to soil the bonds of the state .t Oregon as hereinafter-provided, in .an amount sufficient to raise enough money to meet too requirements or this act. . Provided, that not more than 1 1,000.000 In Tonds shall be issued .hereunder during the year 1917. and that not more than $3,000,000 in addi tion to any surplus unissued or unex ' ponded out of the 1,000,000 authorized for the year 1917, sball be lasued dur ing the year 1918. " Section B. The atte hlrhwav com mission is hereby authorized, empow ered and directed to enter Into such : contracts, appoint such officials, and A, any other act or thing neces&ary 'to frilly meet the requirements of this . Terms of Bonds Fixed. Section 3L The attorney general Shall, under the direction of the state - gasbway commission, prepare a form vt Interest-bearing gold bond of the Stats of Oregon, to be sold in order to provide funds for the carrying out f the purposes of this act. Said bonds Shall be numbered serially, beginning -s-t number 1, and ahall be payable in the order of their issuance. Said state highway commission la hereby author- - laed, empowered and directed to issue bonds of the state of Oregon for the purpose of carrying out the provisions , of this act in an amount not exceed- tng 18,000,000. of which cum, at least 1600,000 shall be issued in denomina lions of 1500 t ach or less. The bonds Issued in any year under the provisions f this act shall be payable one-twentieth each year, commencing with the v sixth year after the Issuance thereof. One-half of the bonds payable each 'Tear shall be navabla on th first d&v , f April and the other half on the first day of October. Each bond shall hear upon its face a statement show ing the date of its maturity. Said 'bonds shall bear interest at the rate i of four per cent per annum, payable semi-annually on April l and October 1. Principal and Interest on said bonds .Shall be payable at the office of the State treasurer at Salem, Oregon, and If said state highway commission ; 'Shall so direct, said bonds may also ,.. provide for payment at some other place. Said bonds shall be in a form . '-embodying an absolute promise of the state of Oregon to pay the amount "thereof in gold ooin of the United Btates of America of the value and Such bond, and ehaM be in such de fcominaUons a the, etate highway com- signed by the governor, secretary of srtete and state treasurer. The above map shows the proposed routes of the three classes of roads as set forth in the act thajtthe voters of the state will pass upon at a special election June 4. The state -treasurer, is authorized and directed to make any such payments of principal or Inter est on said bonds at such places, other than at Salem, Oregon, as the state hig-hway commission may provide. All bonds and interest coupons upon pay ment shall be deposited by the state treasurer with the secretary of state to be attached to the original claim of the state treasurer for the payment thereof. Advertisement and Sale. Sectioa . The state highway com mission shall provide such method a it may deem necessary for the advertise ment of . each issue of said .bonds be fore the same are sold, and shall also require such deposit with bids as may be required, and generally shall con duct, the . sale and issuance of said bonds under such rules and regula tions not Inconsistent with this act as shall be adopted by said commission. Section S. The money arising from the sale of each issue of borids uhall be deposited in- the -state treasury to the credit of a special fund, which aliajl bo used in carrying into effect tha provisions of this act. The secre tary of state is hereby authorized and directed to audit all claims incurred in carrying out tho provisions of this act in the same manner as other claims against the state are audited, and pay the same from any moneys provided by law for tha payment thereof up on the submission of duly verified vouchers approved by the commission; provided, that bonds and coupons shall be paid as is ..provided In section S hereof. Boads of rirst Xmportaaoa. Section 6. The highways described in sections and 7 Of this act are hereby determined to be highways of rirsc importance to in general puoiic of the state of Oregon. It is hereby determined that the following should ba-permanently constructed - and fin ished with a hard surface. 1. -The Columbia river highway from the Multnomah county line to Astoria, Seaside, and south In .Clatsop county to the Tillamook county line. Inas much as the counties of 'Columbia and Clatsop have already expended large sums of money In constructing the said Columbia highway through, said counties and in doing so have practi cally exhausted their ability to raise money by an issuance of county bonds, the state highway commission is here by authorized, from the funds arising urider this act. to use from said funds sufficient to provide for the prepara tion of said highway through said counties for the pavins thereof. 2. The Paclfio highway from the Multnomah county line through Wash ington county and Yamhill county by way of Hlllsboro, Forest Grove, Mc MinnviUe to Dallas, Monmouth and Independence, in Poik county to Cor vallis and Monroe in Benton county, and through Eugene to the north line of Douglas county. - 3. The Pacific ' highway from the Multnomah: county line through Oswe go. Baker and to the Idaho line,, as the1 county courts pt the various counties affected i shall agree to prepare the road ready ESSENTIAL PROVISIONS OF ROAD BONDING ACT AN ACT to provide for the construction of roads and highways In the state of Oregon; to provide for the Issuance of bonds by the state to raise money to carry out the purposes of the act; to designate and authorise the construction of certain hard-surfaced highways, and cer tain nost roads and certain forest roads. An issue of bonds is authorised in an amount hot exceeding $6,000,000. of which not more than $1,000,000 in bonds shall be Issued in 1917 and not more than $2,000,000 In bonds in 1918. Certain hlirhways are designated as highways ' of first importance which are to be permanently constructed and finished with a hard sur face. These in the main Include the Columbia river highwaiy from the Multnomah county line to Astoria and on south through Tillamook county to Nehalem and Garibaldi, and easterly from the Multnomah county Mne to Pendleton, and on to the Idaho- state line via La Grande and Baker; a highway commencing on the Columbia river highway at or near Arling ton and extending to PendSeton via Heppner and Pilot Rock and on to the Washington state line via Milton and Freewator; the Pacific high way via Hlllsboro and Forest Grove to Corvallis and Junction City and via Oswego, Oregon City, Salem, Albany and Junction City, and thence through Eugene to the north line of Douglas county and from the, Josephine county line through Jackson county to the California state Una. Provision is also made for a highway from the Multnomah county line to McMtnnville via Tigard and Newberg. . . Another gTOup of highways designated as post roads to be constructed with federal aid is suggested in the main as follows: The Paclfio high way from the Douglas county line to the Jackson county line; from Rose bunr to Marshfield via Myrtle Point and Coquille; from McMinnville to Tillamook via Willamina; from -Tho Dalles to Klamath Falls via Shanlko and Bend; from Bend to Lakevlew; from the Columbia river hig-hway at a point in Sherman or Gilliam county up the John Day valley via Condon and on to Vale; from La Grande to Joseph and from Bend to Vale via BU Athird group of highways designated as forest roads all to be con structed with federal aid as follows: From Medford to Crater lake and on into Klamath county; from Lane county into Coos county via the Siuslaw river; from Eugene to Bend by way of the McKenate river; from Albany to Bend via Casoadia and a eonoectln; link between the poet road up the John Day valley and the post road from The Dalles and Bend. Proceeds of the vehicle tax are Toexle available for the payment of principle and intereat on bonded indebtedness Incurred in carrying; out this highway program. . The act la to be referred to the people at a special election Jtme 4, 1917, with an emergency clause attached. ' vided. that If the counties of Dougias and Josephine, or either of them, shall prepare any part of the said Pacific highway, and make same ready for pavins; according to the requirements of the state highway commission, then said commission shall Immediately pave the road so prepared, and such portion of said road shall be excepted from the classification as a post road. If the county of Coos shall prepare and make ready for paving, according to the requirements of the state high way commission, twenty or more milies in length- of the post road between Roseburg and Marshfield hereinbefore described, or the county of Tillamook shall so prepare and make ready for paving twenty or more miles in length of the poet road between Tillamook City and McMinnville, and If such por tions of said roads. Each mornings sees a new contingent of dealers and sales men, that have, for the time, been pressed into service ss chauffeurs, ar rive at Lansing;, and one after another drive away to points in Indiana. Ohio. Wisconsin. Illinois and even farther points. Of course Michigan gets most of Che automobiles via the 'drive-away route. Fully one-third of the Reo output Is regularly driven away be cause of the Impossibility of obtaining railway cars enough to carry them." to limit the necessary cooperation be tween this state and the federal, gov ernment In the construction of forest and post roads. No description of any highway pro vided for herein, shall be construed to prevent the state highway commis sioner from making such local changes in the location thereof as they may deem proper. Section S. The state highway com mission is also authorized to adopt such other roads or routes connecting portions of the state and to provide for the construction of post roads or forest roads over such routes and the improvement and maintenaace thereof, and to 'pay for the same from the fund created by house bill No. 21. referred to by title in section $ here of. As to Sard-surfacing-. Section 10. The state highway com mission Is hereby authorised, empow ered and directed whenever the county tlon of any such hard-surfaced road in accordance with plans and specifi cations prepared by the state high-w-v commission, alone routes m. for paving. Provided, that lnasmuen as the county of Hood River has raised by a bond issue and expended upon said Columbia river highway practically its full ..constitutional limit, said commission may extend on said Columbia river highway in Hood River county, such' portion of the money arising' under this act as it may deem proper- in preparing- said Columbia river highway for paving. The vari ous county courts in said counties in eastern Oregon through which said Columbia river highway is projected shall agree upon what portions of said highway are to be paved with hard surface paving and what portions are to be constructed as postroads, and whenever any of said counties shall have prepared a portion of said high way ready for paving, then the state highway commission shall proceed promptly to pave the aame under the provisions Of this, act, - and the re mainder thereof shall be improved as a post road under the provisions of thWact, and such portion so Improved as apost road ahall not be eligible for paving at the expense of the state un derline provisions of this act. 6. A road from the Multnomah county line by Tigard, Rex and New berg to McMinnville. For the purposes of this act the above highways are to be known as hard-surfaced highways. Post Soads. Section 7 The following highways, to-wit: 1. The road running from the north line of Douglas county to the Jackson county line over the line of the Pacific highway as adopted by the state high way commission ; 2. All' that portion of the Colum bia river highway described in the fourth paragraph of the description of hard-surfaced roads as - described in section 6 of this act, which the county courts of the several counties through which the same is located. shall not determine to prebare for pav ing With hard -surfaced paving as is herein " provided, shall be considered a post road, and eligible to Improvement as such under the provisions of this act; . " 5. A road from Roseburg, by Myr tle Point and Coquille to Marshfield; 4. A - road from the Pacific high way, from a point at or-near McMinn ville, by Willamina to Tillamook City; 5. A road from The Dalles by way of Dofor, Maupin' and Shanlko to Red mond, Bend and from thence to Klamath-Falls; : - ' ' - - A road from Bend to LaJceview: 7. .. A. read . from an Intersection with the Columbia river highway at a point either in Sherman or ; Gilliam county, by way of Condon, Fossil and Spray and thence up the John Day val ley to such point as the highway com mission shau elect, and from thence to Vale and the Idaho line; $. A road from La Grande, through Union and Wallowa counties to Jos eph; ' - - . 9. A - road "from 'Bend, A through Burns and Harney to Vale; ' ' shall he known as post roads and shall be constructed along routes between said certain points to be agreed upon by the representatives of the federal government and said state highway commission. 6id post roads shall be constructed according to specifications agreed, upon between the representa tives of the - federal ' government' and said stats highway commission. Tores Beads. Section 8. Roads over the following routes are hereby adopted and desig nated as forest roads, to-wit: 1. . A road from Medford In Jackson county as surveyed and adopted by the federal goverment In cooperation with the state of Oregon, by the way of Crater lake, to a point la Klamath county to ba selected by the said high way commission and the federal offi cials representing the federal govern ment, operating under what Is known as the "Shackelford bill"; 2. A road from a point in Lane coun ty to be selected by the state highway commission and the federal officials representing the federal government, operating under what is known as the "Shackelford bill." by way of the Slus law. river, to a point in Coos county to be selected by the aaid highway com mission; 3. A road from Eugene connect ing Willamette valley with eastern Oregon by way of the McKenzie river to Bend; 4. A road connecting the post road from the Columbia river highway up the John Day valley with the post road between The Dalles and Bend; 5. A road from Albany, via. Leban on, Cascadia and Flab lake,' to Bend. No preference shall be given in the construction. Improving or paving any of the reads described herein by rea son of the numerical designation of such roads. t Provisions of 3C. X. 81. : The funds with which to pay the portion of the expense of the con struction of said post roads and forest roads payable by the state of Oregon, shall be secured from the aale of bonds as is provided in house bill num ber 21, passed by the present legisla tive session, which bill is entitled, -A bill for an act to- accept the benefits ef the act passed by the sixty-fourth con great of the United States entitled, An v act to provide that the United States shall aid the states in the con struction of rural post roads, and for other purposes. and to provide for the issuance ef bonds of the-state of Ore gon to raise such money as may be re quired to meet the, requirements - of said federal statute, and to, authorise the state board of control to take such action and 'perform such duties -as may be necessary to meet the- require ments of said federal act and federal officials acting under said act.- Of the funds made available by raid act for post roads, at least sixty per cent shall be expended on tne above men tloned post roads. In the counties east of the Cascade mountains. - Provided, however, that the above I . provision shall not be eonatrued to Ira-1 , pair the assent of the state lo tbe fed- f era! aid as hereinbefore specified, and ,11, scribed by said commission, and shall have provided for suitable drainage of said roads in accordance with the re quirements of said commission and shall have prepared the foundation in acoosdance with the requirements of said commission, then said commis sion shall let contracts, or otherwise provide according to law for the com pletion of said hard-surfaced roads by causing said roads to be finished and hard-surfaced according to plana and specifications prepared by said com mission, and the funds required there for shall be derived from the sale of said bonds', provided for in section 3 hereof. Section H. The state highway com mission shall pay the interest upon said bonds as the same shall become due. frocn any funds subject to ltd control, from whatever source the same may come, and the payments up on tbe principal of said bonds, as the same shall become due, shall be paid toy the said highway commission from any funds within its centred, without regard to the origin of said funds. This act shall fee re ferred to the people -for their ratifica tion or rejection at a special election to be called in tbe manner provided by law, said election to be held on tbe fourth day of June, 1917. and shall be in full force and effect as soon as ratified by the people at such elec tion.
