S.) - Declaring "that he believes Western Pacific Stock to be without any value whatsoever, E. Delos Magee, receiver for the California Safe Deposit Trust company, today petitioned Judge James M. )eaweli for permission to sell 87,934' shares for $1,131.94. The Par value of this stock Is $$,. 20,, and after the collapse of the be,nk a considerable block of tht stock was exchanged by the receiver With creditors at $10 a share. Recently Ma-ge was given court permlenlon to sell this stock for the best offer he could get He says the bent- he haa been able to get was 5 cents ft share for 1000 shares, and 4V4' centra share for the rest of It He recommends that this offer be accepted, because, he declares, he be lieves the stock Is now without value, and will not be considered in the re organisation of the road. The refusal of the house committee On appropriations to aHow an item of $1,000,000 for th establishment of submarine bases along both the At lantic and the Pacific coasts and the substituted provision creating a com mission to investigate the subject fives almost positive indication that the present congress will not authorise the establishment of a naval base on the Columbia river, according to a re cent letter written by Senator Cham berlain to Wallace R. Struble of Port land. The senator points out the naval base situation clearly and concisely and bfcows that congress Is unwilling to make appropriation for the estab lishment Of a naval base until recom menced by the navy department, which in ium will make no recommendation until its experts have reported on the subject. Senator Chamberlain's Letter. Thi senator's letter to Mr. Struble follows: "I received in diss course your telegram of the 3rd instant, and wired you as follows: "Your telegram in reference to naval base received. It is as unfair and unjust in Its statements as you oould possibly make it and seems to be based on further misrepresenta tion, and misinformation from some source. My personal difference with a man like Harley who misrepresents conditions and undertakes to play politics has not and will not affect my zeal for naval base at mouth of Columbia. The assumption is entirely unfounded and must be baaed on tho misrepresenta tions which Mr. Harley has been makingthrough addresses delivered by him while n Oregon before clvio bodies and in what purported to be Interviews given out by him as to the attitude of Senator Lane and my self with respect to the matter con cerning which you wired me. "Nobody else who has over been here,o far as I am advised, has had tho hardihood and a sufficient disre gard for the truth to make the as sertion either that Lane or 2 looked upon the establishment of a naval Or a submarine base ftt the mouth of the Columbia river as a joke or are apatheUo in our attitude toward it. Vary Department Against Action. "The fact is, we ha' both been as active as it was possible to be in the matter In the face Of tho atti tude of the navy department here, which has so far been unwilling to lecommcnd an appropriation for the establishment of a naval ban either at the mouth of. the Columbia rlvef or elsewhere. 1 was perfectly frank with Mr. Harley when he first came on here as to the legislative situa tion "1 did not think it would he pos sible at this session Of congress to get through a hill appropriating money for he establishment of a naval base, and my repeated efforts along this line have so fAr failed to convince the secretary of the navy or any of those connected with the department of the propriety of ex pending a large sum rmoney for me esiaDiisnmeni oi sum e. rang m , ahy point along either coast without first having a report trom experts on tho subject. Kefers to 1900 Beport. "The nearest approach that the de partment has ever come to ft favor able consideration of such a proposi tion was in their report of 1900, and if you w.li read that carefully you will find that that was not a recom mendation for the establishment it a base at the mouth of the Columbia river, but merely a suggestion that under certain conditions a naval base ought to be established at that point. "I have had this matter up more than once, and long before the people of Oregon sent any one here In fhe interest of the matter Introduced a bill bearing on this very subject. My frankness t Mr. Harley, I assume, led him to conclude I was opposed to the wishes of the people of the northwest on this subject, but I have tried to be. frank in all these matters and not to indulge in statements Which would mislead the people as to actual conditions here. Many Courtesies Shown Xariey. "I introduced Mr. Harley to the chairman of the naval affairs com mittee. Honorable Benjamin R. Till man. The latter was of the opinion that the proper place to consider it waa before the house committee, be fore whom the naval appropriation bin was pending. "Notwithstanding that. Senator Lane and I secured a promise from Senator Swanson of the naval affairs committee that he would endeavor to get the naval committee of the sen ate together and accord to Mr. Har ley a hearing, although he, too, shared the opinion of Senator Tillman that the matter ought first to bo taken up with thp house committee. 1 am in formed that when- Senator Lane suc ceeded in arranging a time" for the hearing before the senate committee Mr. Harley was out Of the city. Daniels Makes Recommendation. "Secretary Daniels in his estimates : for naval expenditures this year rc- otnmended an appropriation of $1.-, 0O0.000 for the establishment of IS submarine bases along the coast line, ' two. of which were to be established on the. Paeiflo coast The committee of the house refused to allow this estimate, and therefore no appropria tion is contained in the house me&a- ure. ' ' I do not know what efforts Mr. j llawley or any Of Oregon's represents-i tires made in the house to secure an amendment to the bill when It Was i pending there. TjEORUE K. CHAMBERLAIN." FORD COMPANY LOSES FEDERAL COURT CASE TO ENJOIN BOONE CO. Judge Bean Dismisses Suit, Holding Defendant Was Not Posing as Agent, The Ford Motor company of Detroit was yesterday denied a temporary in junction against Benjamin E. Boone St Co. by Judge Bean la federal court. It was asked hat the court enjoin the Boone company from the us of the Ford name or trade mark In telling cars, and from representing itself to a Ford agent. Judge Bean said that It had not been shown that the Boone company , had represented itself to be a Ford agent, and that what it had done was to repre sent that It wag Belting Ford cars. The Ford company also Suited that the Boone' company be restrained from using the Ford trade mark on oil cans; but Judge Bean held that the Ford company itself had not shown that it was entitled so to use the trade mark. The charge that the Boone company had obtained Ford care by subterfuge, so that they might be sold to foster the Impression that the company was a Ford agent, was dismissed by Judge Bean's saying that it had been shown that Ford agents who were overstocked with cars had come to the Boone com pany to take the tars Off their hands. The first suit between the two com panies was In circuit court? Tho Ford company filed a suit to eenjoln the Boone company from selling Fords at less than list price.
