,-: THE OREGON DAILY JOURNAL PORTLAND. OREGONJ I. COUNCIL REFUSES TO GIVE OVER $100,000 jf FOR ST. JOHNS, PLANT :P Compromise Offer of Water f j" Company of $109,550 Is Rejected by Commission. , : WHOLE MATTER REFERRED City Attorney Asked for OptnJoa as to JUg-nts of Poniind to Build Own System. Rejecting th compromise price of 1109,550 of the St. Johns Waterworks & Llg-htlng; company for its water pl&nt and system in fit. Johns, the city council by a three to two vote this warning referred the entire St. Johns atr question to City Attorney I a -Roche for investigation of the cit's legal rights, should it urxJextake to build a water system of Its own with in the district. The action today mean that either j the officials of the company will have 'to still further lower the price of their p'ant or the city wl'.l attemjt to build a plant of its own. Commissioners Daly, Big-How anil Baker voted to reject the offer after Cotruwi as loner Baker had explained 'that the council, with the exception f Comrr.tss 1 one r Dieck, hud agreed or, final offer of $100,000 for the sys- tem. Mayor Albee and Commlssionrr .Dleck opposed rejecting the offer, stat- tr that they believed it waa a fair .price for the system. Litigation Is reared. :". " atlll feel.' said Daly, "that ti.o City's original offer is all that the 'plant la worth to the city of Tort land, looking at it from an operauntj Viewpoint. We are operating the wa . terworks and do not fetl that the new - amount proposed by the company ! - What we should pay for the plant." "Well; Bhe people of St. Johns want " a lower water rate," explained Cora- mlssioner Dleck. "and if we reject ' this offer, which I think is fair, we'll .probably throw the whole thing Inti litigation and the people of St. Johns - will not get a lower rate for several years. I think that they should be ' considered. The 1103,550 is the value .fixed by Engineer Clarke of the water .bureau and 1 believe that if the coir. " : pany is willing to accept this amount :J'we should pay it." ;? "It was definitely understood," said Baker, "that J10U.O00 should be our "final offer. Of course, if there ate' i the value of fixtures which were not! taken into consideration anything up 1 to $109,000 might be reasonable, but I 1 do not feel like breaking my agree-1 4 ment." Matter Is Bef erred. 'r Miyor Albee explained that it was ' not his understanding t:iat the $100,000 -offer had been definitely decided upon ;' but had been reached on figures pre aented by the water bureau and which " I were later changed. .". ' Commissioner Dleck moved that the f 109..550 offer be accepted, but as no - one wai willing to second the motion, '. Mayor Albee, presiding, had Comnus- s: sloner Daljr take hla chair and aec- - onded it himself. It failed, however, ;"" owing to the votes of Commissioners Bigeiow, Baker snd Daly. . ' At Commissioner Daly's suggestion ' the entire matter was referred to the legal bureau. City Attorney La Koche -baa already held that company doej Jiot hold an exclusive franchise l L supply water in the district while at- .' torneya for the company contend that -; their franchise is exclusive and tne "-'City has no right to invade the terri- - ; tory. COXFEKEXCE TO BE HELD Authorities to Discuss Action : Toward Fir Insurance Agent. , - Harvey Wells, state insurance coni misaloner, will hold a conference Tuesday with Fire Marshal Stevens and District Attorney Kvans to deter mine what action should be taken against the Insurance agents who Is sued fire insurance policies on vacant houses and on buildinga not in exist ence. c' Commissioner Wells was in Portland late yeeterday afternoon, and after a , short conference with Stevens decided to have the meeting Tuesday. Charges have been made to Fire Marshal Stevens that agents Issuing policies have Interfered with the United States mails. Stevens says that one agent, following the expose, fearing that his policy would fall into the hands of those handling the inves- " ligation, stopped a mail-carrier, and. misrepresenting his identity, got the policy from him before it was deliv- - ered. " -Assistant Postmaster Durand, how .ever. says that he has heard of no . Charges,- and that the postal depart : meat will take no action until defi nite charges are made concerning In terference with the mails. " Gasoline Station Discussed. The question of prohibiting gasoline filling stations on sidewalks from the automobile parking district, from ths congested district, from the fire limits and from the entire city was discussed by the city council today, but action :JWs postponed until next Wednesday. A delegation of garage owners. headeU by F. McKenney, president of the Garage Owners' association, urged that all filling stations be prohibited from ths Sidewalks and placed within the building lines. T. T. Geer thought they Should) be removed from the entire City. Action was postponed to allow , the ..council to make a personal Inves tigation. St-.
