Rose Eytinge. gcd 72 years, once leading woman of the Wallark Stock company nnrl well known as a writer and dramatist, died yesterday at the liurnswlck home, Amityville, h. I. The career of Miss Eytinge was of peculiar brilliance. he at one time being among the most fa mous actresses of the country. Eleven years ago Miss Eytinsc retired from the Ftage, haying reached an age far beyond the allotted time given actresses by custom and precedent. Even after retiring sha appeared for a season 1906-7 In the production of "In the Bishop s Carriage." Rose Eytinge went on the stage at the age of 10 In children's plays, and became a great favorite about l&tiO. She appeared In support of Edwin Booth in 1162. In the season of 1S68-69 Miss Eyttngo was the leading woman at YYullark's theatre. In 1871 she made a great hit as Nancy Sykes in "Oliver Twist." In 1873 she became the leading woman of A. M. Palmer's Union Square Stock com pany, remaining in that position three Seasons. SubBeyutntly she KtarroU in Rot, Michel," "ilias Moulton" and "Love's Sacrifice." As an author Miss Eytinge wrote a . number of books. The 26th legislative as sembly of this state passed house bill 21rt, being an act appropriating JJS, :5! 92 for the support of the etuto mil veislty of this state. Wltlfin 90 days from adjournment of the legislative as sembly, a petition was filed with the secretary of Btato, demanding reference of tills measure to a vote of the elec torate of this stnte at the general elec tion. If the petition Is a valid exercise of right reserved by section 1 of article 4 of the constitution, then tho net does not become operative from and after the expiration of SO days after the adjourn ment of the session, but Jt is stayed and iiiust be submitted to a vote of tho people, as liemundnd In the petition. Hut If it Ik not a valid petition, it cannot have that power against the measure and the latter becomes law." v. On showing that any petition filed is legally insufficient, the court may enjoin the secretary of state and all the other officers from certifying or printing on the official ballot for the ensuing election the naiiot title anu number of such measure." On the point of the alleged Improper form of the petition. In that a copy of the measure was not printed at the head of each sheet. Judge Galloway, among other thlngB, quotes the Oregon supreme Court In Palmer versus Ben ton : Evidently the petition must bo on every sheet on which signatures are to be placed, but the act will be on a separate sheet, etc "The reason for this requirement is obvious? ami substantial, and cannot, with any degree of fairness, bo de nounced as a mere technicality of law. Hut, in fact, it is a most essential and salutary provision, as t lie facts of this case will demonstrate." Bntles of Circulators. Judge tlallowny also holds that cir culators of Initiative and referendum petitions have all the responsibilities of election officials when he sayB: "If, as usually happens, a number of persons Joined In the same petition, each one vouches for the same petition, each one and if tlm latter committed frauds in preparation of the petition, those who signed it must bear the consequences at least to the extent of the right to have their names counted thereon. For, In case of an election where t lie people select election officers, and they disre gard their duty and aid in committing frauds on election, voters must lie- re sponsible for the conduct of officers to the extent of losing their votes, al though they may be Innocent of fraud. "The right of petition reserved by the constitution to refer to u vote of the people any ineusurc passed by the leg islature, was not intended to be used to settle or adjust private and local grievances, but the measure contem plates the right to express the honest sentiment of disaffected voters upon public matters only. The evidence in this case disclosed that the petition or iginated in a case of local neighborhood contention and spite and that in carry ing into effect this unworthy motive, means were employed to obtain signa tures upon a money basis and to further a personal spleen and revenge by a com mittee of Cottage Grove citizens." FIREBUG IS SUSPECTED (Sjieclnl to T1ii Journal.) Khaniko, Or., Pec. 21. The fihaniko hotel was destroyed by fire at 6:30 o'clock this morning causing a logs of $12,000. The building was unoccupied except by a caretaker, having been closed by attachment of thi Condon National bnnk, against E. O. Hogers of Condon, several months, ago. The fire, started in tho cold storage room ad joining the main building in the rear and this circumstance is regarded as auspicious. Insurance Is unknown. MERMAID IN SURF WITHOUT HER HAT ON CONNECTICUT BEACH Following the death of her son sev eral years ago Miss Eytinge came to Portland and lived in retirement among Dew scenes and new friends. .Death took her children In her declining years and the shock nearly broke her brilliant mind. About three years ago she went to New York and since that time had lieen cared for by the Actors' Fund of America. During recent year's Miss Eytinge had b.-eu an invalid, paralysis last eating up the waning vitality. Miss Eytinge was a woman of wun tlerful brilliance, courage and pride. Jluring her stage career she accumu lated' three fortunes and lost each in turn. A woman of open hearted be nevolence, she was wont to give without Hint, and at the same time many of lier business arrangements were turned I to her disadvantage. It is said that Hen 0'eal. the well known New York mana ger, gave Miss Eytinge credit witlr' be ing the most remarkable woman given the world by the American stage.
