The point at Issue Is whether the collection of the bond Is an executive or legislative function nnd because of his doubt Mayor Pane will wait for an opinion from Mr. Kavanaugh before commencing any action. Mayor Pane takes the stand that the pond origin ally emanated from the council and whether it passes from i lie legislative body to the executive branch of tho cltv government because of lis forfeit ure Is som-tliing he wants dei.!e. i.e. fore he takes any action In the matter. Councilman Wallace, on the other hand believes that while the council demanded the posting of ihc bond as a guarantee of good faith that It Is uu to the executive Drancn or tne govern ment to collect It. Furthermore Coun cilman Wallace Is particularly anxious to have the bond collected. He says that the company promised faithfully to have tho line completed on time nnd posted a bond to Insure Its promise. He therefore believes that the city should hold the company to Its agreement. Council Is Divided. While but. few of the ooumilmen have t.voi-essn,t .hemselves In regard to lhe collection of the bond It Is evident from il,.. onloiotiK of the few that there will! b- a difference of opinion as to the ad vlsahllitv of compelling 1 1 1 - railway company to give the city so large a aom Councilman Baker sale! that he was not ready to give an opinion and thought that if the company can show that It acted In good faith with the citv that It should not be pressed too hard He said that this should be es pecially true if the forfeiture will seriously embarrass the company in completing Its present line from Port land to Hillsboro. , Councilman Holding takes the oppo site stand, however. He claims to he the man who first insisted that t he company post a bond with the city. He said nt the time the franchise was is sued that tho Oregon Klectrtc company was after a franchise between the same cities. There was much blowing of horns and ringing of bells over the nronositlon of the T'nlted Hallways company while there was comparatlv little noise about the Oregon Holding said that he asked to companies post forfeitures as e vidence of good faith. Demands the Torfeit. Inasmuch as the Oregon Fleet He completed its line and has Its system In operation while the Pnited Hallways failed after both had put up an equal forfeiture. Redding believes that Hi I"nitP'l Railways should pay its f'irfeit Officials of the I'niti-d Hallways com pany take the opposite view of tic matter. They say that they have been j hampered and hindered by spite work . on the part of politicians and capital-i lata and believe that the city should not attempt further Injury by serious- j ly crippling them while they are pro ceeding as rapidly as posriblo with their present line to Hlllsboro.
