In the case of Myers et al. vs. Portland, Judge Gantenbeln said that a " personal view of trie premises was un necessary and excluded testimony tend ing: to show that such view was not made. In the latter case the court based Its ruling upon the case of Davis vs. Baglnaw. 87 Mich. 439. In that case the court said: 'Nor does the validity of the special assessment depend upon the fact as to whether or not the mem bers of the council viewed the property assessed, or the assessment district with " reference to that particular action. Aldermen are presumed to know the lo cation and condition of the streets. They are supposed to act upon this general knowledge and upon the Information (urnished by committees and by agencies whose duty It is to collect data and arrange details. Nor does It affect the validity of an assessment that the assessor or city engineer furnished the Information or data upon which the council acted, or that these officers act ually outlined the district provided tne council adopted, approved and confirmed their action." Hot Required by Charter. "The charter of the city of Portland does not provide that the auditor must view the premises. Ritter and also of a Mr. 1 rake, lias begun suit In the circuit court to reform a deed to prop ji erty given Tier by her lafft husband and 2 to declare void a chain of other deeds I resulting from transfer of the same , property to Ritter's son, Edward L. Bitter. She declares that her husband 1 practiced fraud upon her and knowingly f - cave her a defective deed to certain Al- blna property in December, 1906. . 5 In the suit started yesterday Edward I Ritter, R. O. Busse, D. Hardowick i and Mrs. Bardowick are made parties defendant. Edward L. Ritter received I a quit claim deed to the property in ' Question on April 1, two weeks after I the date of his father's last divorce, f r the elder Ritter also having been more i than once married. In May, as Mrs. i v Drake-Ritter alleges, young Ritter was i given a warranty deed to the property by his father. He soon sold the land to Busse and the latter passed It on to the Bardowicks, In whose name the title now stands., i Mrs. Drake-Rltter asks for an lnjunc- tion to prevent further transfer of the property pending the decision of the case. Ritter Is 68 years of age. He was refused a divorce by Judge Frazer last year, but his wife was more suc cessful last May before Judge O'Day. at which time she said her husband was so stingy that he would lunch on sour wine and doughnuts in the shade of the porch without offering her a bite. Bhe said he refused to buy her a bottle of medicine when she was sick until she gave htm 60 cents to pav for It.
