Helfrl6h, express messenger and base ball fan of Spokane.' One of the chief , complaints of the wife was that her hus band attended the ball games while he left her to look after the chickens and . cows on the ranch, but desertion was ' the ground orv which she sought divorce. . Previously she tried to obtain a divorce in Spokane on the ground of cruelty and - met defeat. Judge O'Day, in giving his . decision, said he thought the evidence ... would 'sustain a desertion charge and he : was satisfied that we Helf rlchs cannot live together asaln. Ha said that had he been in the position of the Spokane Judge two years ago he probably would - have refused a dlvoree also, but the sit uation is different now. The court de clared it would not be to the interests of the litiganta or of society to refuse a - legal separation at this time. ., .. . J. Ledbury, a Cleone farmer filed an Information ' In Judge Raid's "court to day charging three Hunter brothers, also of the Cleone distrlot, with assault and battery. The trial of the Hunters has been set for June 20 at t;iO. Led bury says the assault took tilace on Ms farm last October. He ordered the Hunters off his ranch on which they were hunting. They set upon him and beat him so badly he was confined to his bed for three weeks, he says. They also promised to kill hint should he attempt toj "use the law on them." according to Ledbury. Ledbury filed charges against the Hunters at the time the assault occurred but the ease was overlooked by the court.. " To Southern Pacific Railroad com pany bavins failed to permit of a con nection between its tracks and those of the United Railways company In South Portland, the railway commission will have another hearing of the matter June I at 1 o'clock p. m., In the Chamber of Commeroe auditorium. When the for mer hearing was held the commission directed that the two companies should agree on a connection, to be built by the United Railways company. It was directed that should they fall to agree as to the manner of connection within 40 days the commission would specify the mode of connection. This will, it Is expected, be done at the coming bear ing. i Judge Bronaugh In the circuit court is hearing evidence today in the case of C. B. Webb against the Doernbecher Manufacturing company, in which Webb is seeking to have the company prohib ited irom using a roaa over nis prop erty adjoining the Doernbecher factory Site in the York addition. He alleges that the company is a trespasser, but the defendant asserts that the road is the only practicable outlet from Its fac tory, and that an easement has been established by long use or the roadway. It acDeara that be road was cunt ty the Hawthorne estate before the erty.was sold to the defendant. prop- Jos Werthelmer, manager of the mov ing picture show at J 51 First street, was arrested at 10:10 last night by Of ficer Fred' Graves or permitting his show to run over the limit prescribed by the city ordinance. Werthelmer, however, was arrested at his own re quest. The moving picture show man agers of Portland wish to test the con stitutionality of the ordinance which provides for the closingof this class of shows at 10' o'clock. Werthelmer was selected to make the test case. He will have a hearing, before Judge Cameron tomorrow. Bids to furnish over 1,000,000 feet of lumber for use in building the Pan ama canal are called for by the Isth mian canal commission in circular No. 448, just received by the Chamber of Commerce. All bids must be In at Washington by June 16, and must be accompanied - by a check or bond for 16 per cent of the bid. The bulk of the lumber asked for consists of planks, sills and flooring. Copies of the cir cular and necessary blanks can be ob tained at the Portland Chamber of Commerce. The Mount Scott Improvement asso ciation met Monday evening at the Ar ista club hall, with President K. T. Naghel presiding.
