He said he had read In the newspapers that the Alliance was, minus part .- of her pro peller and. Hence thought there would be a good chance to get a tow. He offered no explanation for holding the telegram. 45 minutes after speaking the Alliance excepting- that he did not deliver. It. This was the particular feature of tha transaction -that- prompt ed Captain Olson to bring- the charges. Since It ' Is contended that ' Captain Bailey was well aware of the contents of the telegram. - ' Captain Conway. superintendent Not the O. R. A N. water lines, testified to having heard of the Alliance being off the river on the evening: of December 2. and that he called up the company's agent at Astoria for more explicit in formation. The agent told him that thi Tatoosh had returned. Captain Bailey stating .that .the captain of the Alliance would not accept a tow unless the price be named. He called up F. P. Bsum gartner, agent for the Alliance, and an agreement , was reached at once to In struct Captain Olson to accept the srv ices of the tug, the price to be settled later by Captain Conway and Mr. Baum gartner. The -telegram was delivered to Cap tain Bailey about 9 o'clock that nleht but. the tug did not. start out until the following morning. Captain Conway' said he Interested himself particularly in tne case necause tne glass in his of fice that afternoon Indicated that ai storm would spring up that night. He rushed the . telegram through, but -the tug did not go out till the following morning at daylight Other witnesses called .. were Bar Pllota McVlcar and Staples for Captain Bailey and Purser Harry Skinner, F. H. Clark. S. G. Stevene and A. Ansorg for Captain Olson. - Ansorg waa a paa aenger on the Alliance.
