Truman, an employe of the city i, Ire department, sold nis salary, war rants for January and February to Ash ' ley & Rumclln, salary brokers, but has "tnce notified the city treasurer not to : cah thm and claim the warrants him aelf. The city treasurer being thus be- tween two fires, the city attorney has brought suit in the circuit court in the name of the' -city against Truman and i the brokers as well, asking the court to decide to whom, the money on the war rant should be paid. - The question Is apparently the old On one side the transaction is looked upon as a sale of the warrant, but from . another slant It looks like the charging of usurious Interest on a loan, in this case, however, there may be some points to make it vary from the uSual broker age transaction. : " Tfnrrv R. Miles Medical Co., Elkhart, Ind TAX ORDINANCE INEFFECTIVE City Attorney Bules New Law f annot be Nullified by Keferendum. Citv Attorney John Kavanaugh has ruled that the vehicle tax ordinance is In effect; that It cannot be nullified by the referendum, and can only be re pealed by the council or by the electors at the next city election. This Is the ordinance which was passed over Mayor rane s veto February 24 and which Councilman Kellaher has started refer endum petitions against Councilman Kellaher says that he will II. .L l'n J .11 a lieu 1 1. .11 i., inv iiij ni tornev's opinion, holding that Judge Cle land held to the opposite side In a de cision rendered the other day. Mr. Kel laher says that he will go ahead with the referendum petition. City At torney Kavanaugh's opinion follows: Caa Suspend Operation. "Under the amendment and the con stitutional provision no act can tske ef fect until 90 days after the adjournment of the legislature, except the class of emergency acts enumerated In the amendment. Therefore no law on which a referendum can be demanded can take effect during the time in which a refer endum petition can be filed, but this first suspension arises from the pro visions of section 28. article IV, rather than from the provisions of the amend ment, because the law could not take effect for 80 days after the adjournment of the legislature, even If a referendum petition were not filed. "The referendum petition, however, will suspend the operation of the, stat ute until the next geneval election. But In such case a referendum petition is Interposed before the law takes effect. The filing of a referendum petition after a state law becomes operative would have no legal effect. The same rule ap plies to municipal ordinances. What Is the purpose of the referendum? It Is to determine, by vote of the electors; whether a measure that is not in effect shall become a law. An existing law, state or municipal, cannot be displaced by the referendum. It can only be ab rogated by repeal. A repeal of this ordinance might be secured by Initiative petition, or the council may repeal It by ordinance. If an existing ordinance could be suspended pending the filing of a referendum petition, or from the filing of such petition until the next city elec tion, such suspension would result in great Inconvenience. Hepeals Former Ordinanoe. "This ordinance by its terms provides a new schedule of licenses, and repeala the former ordinance. The former or dinance Is repealed and this ordinance Is In effect. If the operation of this or dinance be suspended, then no license could be collected until after the next city election. If such power of sus pension exists, it might be exercised at any time prior to 60 days before the next election. Other ordinances might be suspended. The ordinance assessing the riyit of a public improvement could be held In abeyance. A referendum might be demanded upon appropriation nAM I. "It was never Intended that a law or ordinance, once in force, could be de feated by the- referendum. That there Is no provision in our law for the sus pension of an ordinance is one of tns defects of our present system. Others will no doubt develop In the course of time. It can be remedied bv an ap propriate provision in the ordinance It self, by a charter amendment adopted by the electors, or by another constitu tional amendment. The legislature is powerless to afford relief under the present constitution. It is unfortunate that this defect was not discovered and provided for, but In the present situa tion the law must be, applied as it ex ists." . Metiger, jeweler, optician, 342 Wash ington. .
