Wells and his confederates, it is
charged, had hundreds of old defunct
state bank notes sent to Portland from
Chicago and then passed them off for
good money. They cannot be tried for
counterfeiting so the government offi
cials are to make-an endeavor to con
vict them of using the mails for ille
gitimate purposes.

In a little less than two hours the
Jury In the case of John Wynne,
charged with the murder of W. H. Du
Puis, found him guilty of manslaughter.
The verdict was received by Jadge
O'Day about 5 o'clock yesterday aftes-

evident that the state coultl not hope
for a verdict of murder in the first de-

Citv Attorney John Kavanaugh has
ruled that the vehicle tax ordinance is
In effect; that It cannot be nullified by
the referendum, and can only be re
pealed by the council or by the electors
at the next city election. This Is the
ordinance which was passed over Mayor
rane s veto February 24 and which
Councilman Kellaher has started refer
endum petitions against

Caa Suspend Operation.
"Under the amendment and the con
stitutional provision no act can tske ef
fect until 90 days after the adjournment
of the legislature, except the class of
emergency acts enumerated In the
amendment. Therefore no law on which
a referendum can be demanded can take
effect during the time in which a refer
endum petition can be filed, but this
first suspension arises from the pro
visions of section 28. article IV, rather
than from the provisions of the amend
ment, because the law could not take
effect for 80 days after the adjournment
of the legislature, even If a referendum
petition were not filed.
"The referendum petition, however,
will suspend the operation of the, stat
ute until the next geneval election. But
In such case a referendum petition is
Interposed before the law takes effect.
The filing of a referendum petition after
a state law becomes operative would
have no legal effect. The same rule ap
plies to municipal ordinances. What
Is the purpose of the referendum? It
Is to determine, by vote of the electors;
whether a measure that is not in effect
shall become a law. An existing law,
state or municipal, cannot be displaced
by the referendum. It can only be ab
rogated by repeal. A repeal of this
ordinance might be secured by Initiative
petition, or the council may repeal It by
ordinance. If an existing ordinance
could be suspended pending the filing of
a referendum petition, or from the filing
of such petition until the next city elec
tion, such suspension would result in
great Inconvenience.
Hepeals Former Ordinanoe.
"This ordinance by its terms provides
a new schedule of licenses, and repeala
the former ordinance. The former or
dinance Is repealed and this ordinance
Is In effect. If the operation of this or
dinance be suspended, then no license
could be collected until after the next
city election. If such power of sus
pension exists, it might be exercised at
any time prior to 60 days before the
next election. Other ordinances might
be suspended. The ordinance assessing
the riyit of a public improvement could
be held In abeyance. A referendum
might be demanded upon appropriation

Is no provision in our law for the sus
pension of an ordinance is one of tns
defects of our present system. Others
will no doubt develop In the course of

propriate provision in the ordinance It
self, by a charter amendment adopted
by the electors, or by another constitu
tional amendment. The legislature is
powerless to afford relief under the
present constitution. It is unfortunate
that this defect was not discovered and
provided for, but In the present situa
tion the law must be, applied as it ex
ists." .
