"Mr. Kirie had written letters to Colonel V. H. Fries, a financier and railroad mag nate of North Carolina, threatening to kill him unless he settled an lmuglnury lalm for $250,000. Colonel Fries' law- er kept Ellis engaged In correspondence until It became evident that the luttt-r would soon start for the South with a re volver and then Lawyer J. C. Buxton came to New York and after consultation ultli Osborne Hess, of No. 27 William street, arranged an examination of Kills ' by an alienist and his subsequent arrest and committal. When arraigned before Magistrate Fool yexterday Ellis declared that Rev. U. farkhurst would vouch for his sanity and that he wanted to be tried according to the provisions of the Geneva Conven tion. Dr. 1C. C. Dent, superintendent of the Manhattan State Hospital on Wards Islnnd. had testified to Ellis' condition and copies of the titles alleged to have been sent by Ellis were procured. "If you are uot Insane." said Magis trate Pool, "you are a very dangerous character and ought to be prosecuted for sending threatening letters. 1 shall show u little leniency lis your case, however, and commit you to llellevue for examina tion." He added that If Ellis were declared sane former District Attorney Osborne of Osborne & Hess, would probably prose cute him for sending the letters. Ellis is a fine looking man of about 45. I'p to a few year ago he was a to bacco grower at Winston. Salem. N. C, where his wife and son Htlll live, libsl ness reverses culminated with the de struction yf his warehouse by fire and his fortune of $150,000 was practically wiped out. Then Ellis came to New York. For a time he and his wife lived ut the Hotel Empire. He started a wholesale tobacco business here, but the tobacco trust, it Is said, killed it. In February last Ellis began to write litters to Colonel Fries enormous Bums of' money for alleged wrongs. Colonel Fries was president of the Roanoke & Southwestern Railroad Company, which was later absolved by the Norfolk & Western, and Is now at the head of the Wucholse Trust Company, of Winston-Salem. I. attars That Annoyed Priee. At first Colonel Fries paid little atten tion to the maundering letters of his old time lrlend. but on February 2S he re ceived a communication that annoyed lilni. W. B. Kills, of both cash and peace: of mind, who was a member in good standing of aid organization and was doing his ut , most to lead an upright life.
