SENATORIAL COURTESY. The case of Oscar R. Hundley, who twice has been nominated by president Roosevelt as federal judge for the northern district of Alabama and whose nomination the Senate has failed to confirm, shows how power ful a single senator may sometimes be nnder the tradition "senatorial cour tesy which prevails in the upper house of Congress. ,.., , The appointment of Hundley to the federal judgship did not meet the ap proval of the Alabama delegation in Congress. The nomination was Erst sent to the Senate at the last session of Congress. Confirmation of the nomination was opposed and charge against the nominee were filed with the Senate committee on the judiciary, to which all judicial nominations are referred. Late in the session the committee, by a divided vote, reported the nomination favorably; but this did not end the opposition. AH presidential nominations are considered and acted upon in execu tive sessiins of the Senate, execu tive sessions generaly being held after the day's legislative work has been finished. The galleries are cleared, the doors closed and only a few trusted employes who are sworn to secrecy art allowed to remain. As no record is kept of the executive proceeding?, senatorial courtesy prevailing here even to a greater extent that it does in .open, session. A senator may tale the floor and without regard to roles talk as long as he pleases. The sessions being at the close of the day, when Senators are anxious to get away to their homes, conditions are ideal for any Senator who wants to prevent action on any nomination. All he needs to do when the nomination is called up is to rise in his seat and begin ot state his reasons for oppos ing it. After he has talked a while, some other Senator will suggest th&t that particular nomination be laid aside for future consideration, This is promptly agreed to, for otherwise the opostng Senator would talk un til the dinners. of all the other Sena tors were cold, and still nothing would be accomplished. It is only necessary that the opposing Senator be present at all executive sessions, prepared to state over and over again his reason for opposing confirmation. Presently the session is at an end and the nomi nation is unconfirmed. If the Presi dent is determined, he can then gives his man a recess appointment, but un less the appointment is finally eon firmed the appointee can draw no pay. These are precisely the tactics be ing persued in the case of Hundley. The Alabama Senators succeeded at the last session, which was the long session, is preventing a vote on Hund ley's nomination. If they prevent 3 vote between now and March 4, as they can if they are determined, Presi dent Roosevelt will go out of office and the vacancy that will exist will be for his successor to MIL Those who oppose Hundley do not believe Presi dent Taft would care to send to the Senate the nomination of a man for the bench who twice had failed of confirmation. If a majority of Senators were real ly anxious to have a man confirmed they probably would find a way to coerce the objecting Senator and fetch the matter to a vote. But in the pres ent state of feeling, no one is dis posed seriously to bestir himself.
