INDICTMENT WAS DISMISSED Murray Was Killed on an Election Day When There Had Been a Riot at the Polls and Murray and Tay lor Fought cn the Street. KINGSiON, N. Y. April 9.-In some western city, the name of which is scrupulously guarded, lives a prom inent and respected citizen from whom the Supreme Court of New York to-day removed the stigma of an indictment which was returned 26 years ago and charged John Taylor with the death of Thomas Murray. The present home of Taylor and the name under which he has since lived, married and risen to the head of a big merchantile establishment are known to but three men here and his secret will be kept. Taylor's iden tity was made known by him to the court after search for him which cov ered two continents and took several years has been abandoned. Throwing himself upon the mercy of the prose cution, Taylor invited an inquiry into his life for the past quarted of a cen tury. This was made and it proved so satisfactory that former Supreme Court Justice Clearwater, who as district attorney obtained the indict ment against Taylor, decided that it would be gross injustice to reveal the man's new name. To-day Justice W. C. Howard of Try.sitting in the Supreme Court, dismissed the indict ment against Taylor after it had been shown that all possible witness against the defendant were dead. Justice Clearwater who personally in vestigated the case and the present district attorney seconded the action of the court. Only justice Howard and Mr. Clearwater have knowledge of the facts in the case. Ex Justice Clearwater said tonight: "The killing of Murray was a case of love, rum and politics. Man slaughter, which was charged, could not be proven now. Taylor has made a new home and won an honored name. He is at the head of a big LYDIA E. His character is above reproach and it would be an outrage to revive the story now." The killing of Murray and the sub sequent pursuit of Taylor were of great interest. ' Mr. Murray was killed nt Tort day when there had been a riot at the polls. Taylor and Murray were unfriendly for various reasons. They belonged to opposing political parties and loved the same girl. On election day they quarreled at the polls and then fought on the street. A brick with which Murray's skull was crack ed is still in the office of the district attorney. Several days later Murray died and Taylor lied. In 1882 a grand jury indicted Taylor for manslaughter in the first degree and a search for him was instituted. He was traced to Pennsylvania where it was alleged he had allied himself with the Molly Maguires. He escaped from the country but was traced to the home of his mother in Ireland. He was apprehended but again escaped. Later he returned to America and settled in the West. Recently he determined to clear his name. He corresponded with the officials here who had long before given up hope of his arrest and today's dismissal of the indict ment resulted. AUTOS BREAK THE WAY. The New York-to-Paris auto race has a significance other than the mere tests of speed and endurance of the several cars and their drivers. For years the question of the feasi bility of a railway from New York to Paris by the Behring strait route has been discussed and rejected with out action as a faint probability of the remote future. The successful completion of the auto race is almost certain to break a way for such a railroad not through the snowy wastes of Siberia, but rather through the cautious doubts of those who have hitherto opposed it on the ground of impracticability. Some good pictures of several of the rac ing cars en route accompany an ar ticle appearing in the April Popular Mechanics. In Indiana the contest ants had a foretaste of the difficul ties they doubtless will encounter farther north. NEW YORK, April 9.-Robert Ingils, the young athlete who has been in St. Josephs Hospital, yonkers since two o' clock Sunday morning with three stitches in his heart, is re ported to be greatly improved He tells the physicians, he feels very little pain in his heart, which his as sailant's knife penetrated and this is taken as an indication that the wound is healing. His case is now looked upon by medical men as one of the most remarkable in the history of the profession. The record before this case was that of a woman who lived 18 hours after a similar opera tion.
