In the matter of the Local Option liquor election: It duly appears to the court that in the following named election precincts in said county, namely, Alsea, Beaver Creek, Five Rivers, Big Elk, Elk City, Little Elk, Nashville, Tide water and Toledo, the majority of the votes cast at said election on the first day of June i908, in each of said election precincts were in favor of prohibiting the sale of intoxicat ing liquors in each of said election precincts. Now, therefore, the court being fully advised in the premises and having carefully examined the various proceedings herein, and by virtue of the law, and by reason of the premises aforesaid, it is de clared by the court that at the General election held on the 1st day of June 1908, in Lincoln county Oregon, the number of legal votes cast in favor of the prohibition of the sale of intoxicating liquors in said Lincoln county, as a whole, was 519 and the number of legal votes cast at Baid election again st the prohibition of the sale of intoxi cating liquors in said county as a whole, was 522, thereby giving a majority of 3 votes in said county at said election against the prohibi tition of the sale of intoxicating liquors within said county. In the matter of appointing a road supervisor in District No. 9: It is ordered that William Sharp be and he is hereby apjxiinted road super visor of district No. 9 with bonds in the sum of $500. In the matter of claim from special road fund of the City of Newport: Ordered that the County Clerk draw a warrant on special road fund for Newport road district in sum of $158.75 in favor of J. J. Burdett as supervisor of said road road. Claim of James Patterson for $51, allowed. In the matter of a County High School for Lincoln county, Oregon. It duty appearing to the court that at the general election held on the lst day of June 1908 in Lincoln county, Oregon, the question as to whether a County High School should )e established in said county or not was duly and legally submit ted to the legal voters of said county and at said election the number of legal votes cast in favor of a county high school was 603 and the num ber of legal votes cast against a county high school, was 326, there fore, it fully appears that the majority- in favor of such a county high school is 277. And it further appearing to the court that at this time it will not be for the best in terest of the tax payers of said county to permanently locate said high school and erect a county high school building and equip the same until the legal voters of said county have had a chance to vote upon the question as to where said high school should be located. OEEGON It further appears to the court that it will be for the best interest of the tax payers of said county for the high school board of said county to contract with the Toledo Board of School Directors and the Newport Board of School Directors (both school districts are now maintain ing a school of high school grade) to teach all high school pupils at such rate per capita or in the aggre gate, as they may deem right and just, and that the county shall pay for the same out of the high school fund of said county. It is therefore ordered that the perman ent location of the county high school for Lincoln county, Oregon, be and the same is hereby contin ued until the first regular term of the County Court held after the primary election to be held in said county in 1910. It is further or dered that a county high school be maintained at Toledo and Newport under such terms and conditions as may be agreed upon between the board of school directors of each of said school districts and the county high school board of said county. Provided, the county shall not pay more than $800 to each of said school districts for each year during which said high school shall be so maintained prior to the permanent location of said high school. In the matter of the local option liquor election : Ordered, adjudged and decreed by the Court that from and. after the date of this order the sale of intoxicating liquors within the limits of Alsea, Tidewater, Beaver Creek, Big Elk, Little Elk, Nashville, Elk City and Toledo pre cincts, be and the same is hereby absolutely prohibited, until such time as the qualified voters in such precincts and county, at a legal elec tion held for that purpose, by a majority vote, decide otherwise.
