Lard - Keg», hardKeg», or gallon tin?, (Mlle Appended is the full text of Senator Tongue’s law to license stallions kept for public service in the stud and to provide for a lien on colts and mares for stud fees: S ection 1.—It shall lie unlawful for any person, persona or corporation to offer the services of any stallion for any mare belonging to another, or to permit any stallion in his control or owned by him to serve any mare of another for hire in this state without having first ob tained a license from the county clerk of the county where such service is render ed, as hereinafter provided in this act. Sec 2.—Any owner of anv stallion de siring a license for said stallion may file bis |<etition therefor witli the county clerk of any county within the state. Such }>etition shall state specifically the name, color, age, breeder aud last owner of »aid stallion, the name and breeding of sire, and name and breeding of dam, and name ami breeding of the »econd dam of said stallion. If any of the fore going facts required to be stated in said petition are not known to the petitioner, he shall state in said petition that such facts are unknown. Such petition shall be verified by the oath of the owner of such stallion, or by the lawful agent who lias knowledge of the facts. Sec 3.—Upon receiving said petition, said county clerk shall file and preserve the same in his office and u|K>n receiving $1 as his fee therefor, shall issue the ap plicant a license, which shall authorize such applicant to offer and permit the stud service of the stallion named in said petition for mares within the county wherein such |>etition is filed. Such li cense shall contain all facts required to be shown in said petition, ami shall l*e in force until the 1st day of January of the year following the date of it« issue. Sec 4.—On receiving such license, the applicant therefor shall )>ust and main tain a copy thereof in a conspicuous place at each place of standing said stallion in the county wherein such license was granted. Sec. 5—Any owner of any stallion wifhin this state,may tile with the county clerk of any county herein,on or before the 1st day of October of each year, a full and complete list of the mares served by such stallion within such county dur ing that year. Such list snail contain the name of an;, and a brief description of ali the mares so served, the owners thereof, the terms on which ezch mare was bred, the amount of money due, or to become due upon each mare and the time when paymeut thereof becomes due. and it shall be verified by the oath of the owner of such stallion or his law fully authorized agent. Sec. 6—From the time of filing such list the owner of such stallion shall have a lien U|K»n each mare therein described except such as are exempt from execu tion and upon her colt, if any, by said horse, fol the service fee due a» thereon for one year from the date of such filing. Such lien may be renewed within the time, and in the same manner as a chat tel mortgage is renewed. Sec. 7—Any person owning or con trolling any stallion within this state or the agent of any one owning such ani mal, who shall suffer or permit any such stallion to serve any mare or mares of another without having first procured a license,or in an application for a license, «hall knowingly make any false state ment therein, or in filing a list of mares served by any stallion, shall knowingly make a misstatement therein or h I ik II violate any of the provisions of this art, or any person who shall tear down or destroy or mutilate any copy of any li cense issued and posted as provided in this act, shall be doomed guilty of a misdemeanor, and upon conviction shall lie fined not less than $5 nor more than $230, or imprisioned in the county jail not more than ninety days. Sec. 8—.1ustices of the i*eace shall have concurrent jiiri»<liction with the circuit court in all prosecutions arising under this act.
