Both will open for business October 4, aud the consolida tion will be kflected by December 1 By that time it Is thought the Salem university will be also brought into tlie agreement, as there Is not support enough to maintain three universities In Oregon aud Washington. The whole matter Is under the con trol of tlie university senate of the M I'. church. Robbed tlie Grave. utoio oi tiii: n kiiix ,: UI1T OaarJ, Ausu.t n Oue good" Indian and a brother barely missing that condition Is the story of the Fl renee tragedy. Last night's stage brought to this city Constable E A Evans of Florence precinct, having In charge Jeff Harney a Coos Bay Indian aged about 50 whom he turned over to the Sherill who placed him in Jail. Harney killed another Indian Darned Bennett Barney aged 21 at Florence Saturday night, and badly wounded auother named Henry Jacksoa aged about 4i The Instrument he used was a pocket knife with a blade about four inches long. Constable Evans' story cf the atlatr iudlcatea that the prisoner who bears good reputation, is not to blame for lue unlortunate occurrence. To Guard reorter he outlined the matter as follow: On the afternoon of Saturday about six or tne ludiaus living at ludlantowu two miles above Florence on North Fork came to town and spent the after noon drinking. Among them were the murdt redmau and his companion. naruey was also In town aud ti.ij been with the other Indians some. He did uot usually associate with the Indian wwu uravea ana ror mat reason was not liked by them. About 8.30 In the evening the men from Indiantown wemioiiieir ooats about L'OJ yarOs from the city what vet Inleudldg to leave for home. The liquor they drank placed them in a lighting condition and they agreed that Barney aud jacKson suouiu go nack to town, get Harney aud take him with them and for general reasons give him adubl'ilng. A II ... . . . ... is naruey nveu a snort distance up me river be accepted the men's luvlia Hoc lor a ride ho.i.e. They coinnienc eu quarreling with him on reaching the boat, finally pushing Harney in the river and striking him on the head with an oar. He managed to get out and with his knife tabled Jackson two times under the floating ribs. Jackson then ra t away and Barney took up the fight whereupon Harney slabbed him In the abdomen, the blade entering from the side. It was about 11 o'clock that Al Reddy, " w ho lives about 400 yard from where the Indians landed, noli lied the countable that there was a dead Iudian lying In front of his house. The young biave had started for town aud went that far collapsing from loss ol blood Constable Evans, accompanied by his father, Dr R L Evans, took charge of the dead Indian, Harney was then arrested, aud as before stated, brought tothiscltv. The braves of Indiantown are from the Coos Bay, Rngue Klveraud I'mp qua tribes aud by their dissolute habits frequently cause trouble. JelfHarucy does not live with them and bus always had a good reputation among the white people on the river who are ready to give bis version of tlie allalr full credit. WAIVED EXAMINATION. In this connection it might be well to tell a story of the murder tliut Is be Ing repeated by many from McKenzle Bridge to Cobb's sheep camp acros the luountalus, having been told to Mr Armstrong by a x.t Ward, who has a Claim at Lost Creek. According to this story It was first told byeithir Branton or Green, and Is to the effect that after Linn had been shot and thrown on the tire he came to and cried out, "For God's sake, dont burn me alive, boys," whereupou Branton picked up a club, ami silenced the vie tim by breaking bin skull. As the story has gained considerable circula tion it is given for what it Is woith. It Is probably false. HEAVY KOUEST FIKEfi. Eturoit (,fAKt:-Iu Mr McClung's reply to "Voter" In Monday's Guakd he says In part: 'As voter seems to 1 laboring under a mlaapprcdc uslon in regard to the ab sent director of this school district, I beg leave to state that there is no va cancy, as he Indicates by citing the section requiring a special election to be called when a vacancy occurs by reason of death, resignation or other wise. This section has no bearing at this time for the reason that Mr Gil bert I uot dead. His reslmiiilioii hits not beeu accepted and no otherwl-o circumstances have occurred to cause a vacancy." I will admit that from Itt accounts Mr Gilbert I not dead yet I maintain tint a vacancy exists In the board no -wlthstaudlim that fact as contemplat ed by law. Mr Gilbert doubtless felt that lie would be absent for an Indeii ulte time aud believed it to be Ills duly to leslgn as director of the district elf t tie would not have dotio so. When be performed that act a vacancy existe I uotwllhslat ding the refusal of the re maining members of the board to ae- cept his resignation, slnco they bae uo power under tho law to accepter have auy control over it. Ifouedi rector can resign and his resignation held up two might do so and so miitlit they all aud the district left without a board. It matteis uot whether Mr Gilbert lelt Oregon at all or uot or the school district for that matter. When lie put iu his resignation a vacancy ex isted aud It Is not for tho remaining members to say that there Is no vacan cy. As for tlie statement In Mr Mc Clung's letter that nothing but routine busluess is liable to come up during the rest of the year, that has nothing at all to do with the case. Business of Importance Is liable to occur at any time. Teachers may resign and vacan cies have to be filled as was done a short time ago and If but two directors aie ou the board a deadlock might take place a d buslues stop. The district 1 entitled to a full board ol directors to transact Its business aud It is the duty of the present membeis to see that the board Is filled. This has not been written with any spirit of criticism but merely to call the attention of the board and tlie people to the facts In the case. Votek Notice.
