You can ’ t do that and stay in business.” T h e second avenue open to Copenhagen was to create its own sub-contractor as the R .A . H a tch C om pany is accused o f doing by a Federal H ig h w ay A d m in is tra tio n in v es tig atio n tea m , T r i - M e t , the C ity o f P o rtla n d and (he S late o f Washington. “ W e do not have nup tia l ties w ith any su b co ntracto rs, nor do we have any proteges or ex clusive subcontractors who will give only Copenhagen a quote (or when they do quote to others give them a higher quote).” Burt explained that Copenhagen has some unique problems. This is a union contractor and. therefore, all su bcontractors must be u n io n or o w n e r /o p e ra to r , w hich excludes most sm all m in o rity firm s . The company does not provide bonding for sub-contractors, although they made an exception in this case for Salt and Pepper because it had suc cessfully completed prior contracts w ith th em . A ls o , C o penhagen specializes in underground work so w ill not sub out that type o f w ork, the work most available for M B E ’s. (T h e prim e co n trac to r must do at least 25 percent o f the work itself). H a tc h and Cascade specialize in paving so do not sub out paving, but sub underground work, railings, etc. A n o th e r p ro b lem C openhagen encountered was that M B E ’s bid too high to m ake th eir use cost- effective. Burt said in the T ri-M e t bid. Dirt and Aggregate's bid was 53 percent higher than the successful bidder; M B E 's was 18 percent high; Castle R o c k ’ s b id was 17 percent high; and H A H Electric (wom en- owned enterprise (W B E ) co-owned by R .A . H a tc h ’s w ife . Susie, bid 6 percent high. Successful m inority bidders were: A rch ie Lan dscaping ($ 5 ,2 2 5 ); Kaspac ($622); Ed G alang. ($32 per h o u r) and S alt A Pepper ($404,000). According to T r l- M e t ’ s require,- ment fo r the b id , i f the success fu l bidder does not reach the goals, it must provide T ri-M e t with evidence that it has made a good faith effort to meet the goals. M an y o f those who initiated the co m p lain ts that led to the decer tification o f Hopsing and who have requested that R .A . H a tc h C o m pany be placed on the federal and state in e lig ib le lis t, are dism ayed that den ial o f the jo b to Copenhagen will place Hatch-Railco Company in line to get the job. C openhagen says it has met its m in o rity requ irem en ts on all previous jobs and even received a commendation from Commissioner Charles Jordan for its work for the City o f Portland. O ne o f those destined to lose is A d o lp h Evans, owner o f Salt and Pepper, a tru ck in g firm , who was slated to receive a sub-contract for $404,000. “ Adolph is an example o f how we have adhered to the spirit of the M B E re q u ire m en ts,” Burt ex plained. " W e have our own trucks; we d o n 't have to sub out hauling. But Adolph has done good work for us on other jobs so we accepted his bid. He has his own bonding, but it is n 't enough so we are arrang ing bonding for h im ." C openhagen w ill appeal to T r i- M e t’ * general manager and if that fa ils , w ill seek an in ju n c tio n to prevent T ri-M e t from awarding the contract to Hatch-Railco.
